3 <br /> <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 64- <br />? ? <br />BY <br />ti <br />AN ORDINANCE DETERMINIIVG TO PROCEED WITH THE CONSTRUC- ! <br />TION OF SANITARY SEWERS AN D APPURTENANCES IN MASTICK <br />ROAD AND OTHER STREETS DESiGNATED IN SECTION 1 OF <br />RFSOLUTIOti NO. 64-254, AND DECLARING AN EMERGENCY <br />BE IT ORDAiNED by the Council of the City of North Olmsted, <br />Ohio: <br />Ser.tion l. That it is hereby determined to proceed with the <br />constructior of sanitary sewers and appurtenances in Mastick Road and other <br />• Streets designated in Section 1 of Resolution No. 64-254. <br />Section 2: That said improvement shall be made in accord- <br />anre with the nrovisions of Resolution No. 64-254 passed on October 20, <br />1964, ar.d with the plans, specifications, estimates and profiles heretofore <br />approved and n?)w on file in the office of the Clerc of this Council. <br />Section 3; That all claims for damages resulting therefrom <br />that have been legally filed shall be inquired into after completion of the <br />proposed impm,.-ernent, and the Director of Law is hereby authorized and <br />direct to irstitute legal proceedings in a court of competent jurisdiction to <br />inquire into claims that have been so filed. <br />Section 4. That portion of the cost provided in the above- <br />mentior.pd reso?ution of necessity ro be assessed shall be assessed in the <br />manner and `he number o` ins+allmer.ts provided in said resolution and on <br />the lots and lar.ds described therein. <br />Section S. That the estimated assessments heretofore pre- <br />pareci and filed in the office of the Clerk of Council and 3s equalized by the <br />Board heretotore appainted for such purpose by Resolution No. 64-282 adopted <br />on November 17, 1964, the report of which Board was approved by Resolution <br />No. 64- ='adon`ed Der,ember 1, 1964, be and the same are hereby adopted. <br />Section 6. The Clerk of Council is hereby directed to <br />deliver a certified copy of this ordinance to the County Auditor within fifteen <br />days after its passage. <br />s <br />Section 7. S,lbiect to the provisions of Section 727.24, <br />Re.vised Code, the Mayor of the City is hereby authorized and directed as <br />soon as t'rie funds therefor are available to make and execute and contract <br />fo:- said i-npr_overnent with the lo?n?est and best bidder after adcertising <br />arcorciing to ]aw and the improvement shall be finar.ced as provideci in the <br />reso].?_!4:ion o` neressity. <br />Section 8.
