3 CITY OF NORTH OLMSTED ORDINANCE NO. 64- ? ? BY ti AN ORDINANCE DETERMINIIVG TO PROCEED WITH THE CONSTRUC- ! TION OF SANITARY SEWERS AN D APPURTENANCES IN MASTICK ROAD AND OTHER STREETS DESiGNATED IN SECTION 1 OF RFSOLUTIOti NO. 64-254, AND DECLARING AN EMERGENCY BE IT ORDAiNED by the Council of the City of North Olmsted, Ohio: Ser.tion l. That it is hereby determined to proceed with the constructior of sanitary sewers and appurtenances in Mastick Road and other • Streets designated in Section 1 of Resolution No. 64-254. Section 2: That said improvement shall be made in accord- anre with the nrovisions of Resolution No. 64-254 passed on October 20, 1964, ar.d with the plans, specifications, estimates and profiles heretofore approved and n?)w on file in the office of the Clerc of this Council. Section 3; That all claims for damages resulting therefrom that have been legally filed shall be inquired into after completion of the proposed impm,.-ernent, and the Director of Law is hereby authorized and direct to irstitute legal proceedings in a court of competent jurisdiction to inquire into claims that have been so filed. Section 4. That portion of the cost provided in the above- mentior.pd reso?ution of necessity ro be assessed shall be assessed in the manner and `he number o` ins+allmer.ts provided in said resolution and on the lots and lar.ds described therein. Section S. That the estimated assessments heretofore pre- pareci and filed in the office of the Clerk of Council and 3s equalized by the Board heretotore appainted for such purpose by Resolution No. 64-282 adopted on November 17, 1964, the report of which Board was approved by Resolution No. 64- ='adon`ed Der,ember 1, 1964, be and the same are hereby adopted. Section 6. The Clerk of Council is hereby directed to deliver a certified copy of this ordinance to the County Auditor within fifteen days after its passage. s Section 7.
