That it is hereby determined to proceed with the <br />im~provemeut of St+aar~s Road from Lorain Road to northerly l~.ne of <br />Bernard Stearns roperty, by constructing therein a water main, in <br />accordance with Resolution Rio. 1715 passed on the 6th d8y of February, <br />1951, and the petitioxz of property owners described in said Resolution <br />and i.n accordance with the plans specifications, estimat~s and profiles <br />heretofore appratred and now on file in the office of the lark. <br />Section ~. That all claims for damages resulti therefroffi <br />shall be judfciali inq~ired into after the co~pletion ofhe proposed <br />improv t, and t sa ctor be, an he is he eby author z®d an <br />directed to institute proceedings in a court of competent jurisdiction <br />to inquire into such claims. <br />Section ~. That the cost of said 3.~pr©Yt3~i;$I'1t shall be <br />ass®ssed by the foot front upon the following described lots and lids, <br />to wit, all lots and lands bounding and abut'ti upon the proposed, <br />improvement., which said lots and lands are here det®rmined to be <br />specially benefited by said improvement; and the cost of said improve- <br />meat shall include the expense of preliminary and other surveys,. of <br />printing and publishing the notices, resolutions and ordinances <br />required, the serving of said notices, the cost of construction, to- <br />,gether with interest on notes or bonds issued in anticipation of <br />collection of deferred assessments and all other necessary e~:penditttx~ss. <br /> <br />,.. <br />Section 4. That the assessments sa to be levied shall be <br />paid in ten annual installments, ~.th interest Aot t© exceed six <br />percent per annt~ on deferred pay~ents, provided, that the outer of <br />any property assessed may., at his option, pay such assessment in <br />cash within thirty days from and after the passage of the assessing <br />ordinance, in which case said assessment shall not include any item <br />of interest upon Hates yr bonds to be issued in anticipation of the <br />collection of deferred installments of assessments. <br />Section 5.
