CITY OF NORTH OLMSTED <br />ORDINANCE NO.2026 - 6 <br />BY: Mayor Jones <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT OF <br />THE ZONE MAP OF THE CITY OF NORTH OLMSTED BY <br />REZONING PERMANENT PARCEL NO. 236-17-018, FROM <br />MIXED USE "A" DISTRICT TO GENERAL BUSINESS <br />DISTRICT `B-3' <br />WHEREAS, the Schedule of Uses for Mixed Use District A, among other restrictions, <br />permits "Restaurants without drive through facilities". Table 1149.03-1. Schedule of Uses, <br />Accommodations, Hospitality and Entertainment; and <br />WHEREAS, the Schedule of Uses for General Business District `B-3", among other <br />restrictions, permits "Restaurants with drive through facilities". Table 1139.03-1, Schedule of Uses, <br />Accommodations, Hospitality and Entertainment; and <br />WHEREAS, the Administration and Director of Economic and Community Development <br />recommends that the Zone Map be amended to Rezone PPN 236-17-018 from Mixed Use District A <br />to General Business District B-3 in order to accommodate a Restaurant with drive through facilities <br />at the site of the former Lone Star Steakhouse on Country Club Blvd., east of Great Northern Blvd., <br />which has been vacate for a substantial period of time; and <br />WHEREAS, on the2j�kday of , 2026, by formal motion, the Planning and <br />Design Commission recommended / did not recomm nd the adoption of this Ordinance, proposing <br />to rezone the real property, as identified and fully described herein, from Mixed Use District A to <br />General Business District B-3; and <br />WHEREAS, following publication of newspaper notice and notice to the record title holders <br />of real property located within one thousand (1,000) feet of the property proposed to be rezoned, a <br />public hearing was held, in conformance with the provisionof Section 14 of Article IV of the <br />Charter and Section 1127.03 of the Zoning Code, on the gLtday of 1362026; <br />WHEREAS, this Council, upon the recommendation and review of the Director of Economic <br />and Community Development, finds that rezoning Permanent Parcel No. 236-17-018, from Mixed <br />Use District A to General Business District B-3 will further, and bears a substantial relation to, the <br />public health, safety, and welfare, and that said rezoning will promote orderly development of <br />restaurant use with drive through facilities on this parcel of land. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />
