The municipalities and the railroad company agree to excavate <br /> an area at the southwest corner oP Berea Road and West 117th Street <br /> described as follawa: <br /> Bounded by the south line of Berea Road and the west line <br /> of Weat 117th Street, extending a distance oY 150 Peet along both <br /> streets Prom the point oP intersection of said aide lines of Berea <br /> Road and blest 117th Street; and bounded on the south by two lines <br /> drawn at right angles to Berea Road and CVest 117th Street, at a <br /> point 150 feet distant Yrom the point oY ix~teraection oY said <br /> .side Linea of Berea Road .and 14'est.117th Street; said Linea so <br /> drawn at right angles to be extended until they meet. <br /> The said area is to be excavated down from its present grade to <br /> the new grade oP Berea Road and Weat 11Tth Street, as the same shall be <br /> depressed and reconstructed, pursuant to the provisions of the grade elimi- <br /> nation ordiusnoe; and the elope connecting the depressed area with the <br /> natural surYaae of the ground to the south shall be at a grade of 1 Pt. <br /> <br /> ~ •ertical to 1.7 tt. horizontal. <br /> T. Said municipalities and railroad company, are, at their expense, <br /> to design and construct a highway bridge over Berea Road, the center line <br /> oP which shall be about 260 Peet distant westerly from the point oP inter- <br /> section of the center line oY Berea Road with west 117th Street; said bridge <br /> to become the property, and to be for the private use of The National Carbon <br /> Company, its successors and assigns. Said bridge shall be constructed of <br /> reinforced concrete and steel, supported at the street lines of Berea Road <br /> on concrete abutments. The vertical clearance between the under side oP <br /> " said bridge and Berea Road shall be 15 Peet. Said bridge shall be constructs <br /> " to carry 1 line of 20-ton trunks and a load oP 75 lbs. per square Yoot on <br /> the sidewalk area. The roadeay of said bridge shall be 12 feet in width <br /> in the clear, and in addition thereto there shall be a sidewalk 5 Peet in <br /> ` width on one side thereof. The bridge is to De designed by the City of <br /> Cleveland. In addition to the construction of said bridge, said municipalitie <br /> and said railroad company are to construct a roadway approach to said bridge <br /> Prom the new street connecting Berea Road with ~Yest 117th Street as pro- <br /> vided in paragraph 5. The roadway oP such approsah shall be 20 feet in <br /> width and widened to 25 Peet at the curve adaacent to the bridge. Said <br /> - roadway shall be paved with 8 inch concrete base, 1 inch sand cushion and <br /> 4 inch brick wearing surface. <br /> 8. The National Carbon Company la to furnish without charge the <br /> land necessary for the construction of the bridge over Berea Road and the <br /> approsah thereto, Prom the new street connecting Berea Road with West 117th <br /> Street hereinbeYore apeaiYied; and The National Carbon Company shall, at <br /> its own expense, move all buildings, and erect all necessary new foundations <br /> therefor, on the south aide oY Berea Road, owned by The National Carbon <br /> Company, and necessary to be moved to permit the construction oY the slopes, <br /> roadway and bridge hereinbefore provided. The land Furnished for the <br /> approach to the bridge over Berea Road shall remain the private property oY <br /> The National Carbon Company, its successors and assigns; and in the event <br /> that said bridge shall be some dangerous to the public using said Berea <br /> Road, then unless the same shall be repaired to the satiafaetion oP the <br /> City Engineer within a reasonable time, said municipalities shall have <br /> the right to remove said bridge and recover the costa of such removal iron <br /> The National Carbon Company, its aneeeasora and assigns. <br /> 9. In addition to the things to be done hereinbefore set forth, <br /> said municipalities and railroad company hereby agree to pay The National <br /> Carbon Company the sum of X77,250.00; and toward the payment oY the same <br /> and all other costa and expenses involved in this settlement, The New York <br /> Central Railroad Company will pay 65~ thereoY, the City of Cleveland will <br /> pay 17-1~2% end the City of Lakewood 17-1f2~, as their respective portions. <br /> The money to be paid by the City oY Lakewood as herein authorized shall be <br /> sumdahall beepaidcupon thetdelivery torcthedCity ofiCleveland, the Citysofd <br /> <br />
