The municipalities and the railroad company agree to excavate an area at the southwest corner oP Berea Road and West 117th Street described as follawa: Bounded by the south line of Berea Road and the west line of Weat 117th Street, extending a distance oY 150 Peet along both streets Prom the point oP intersection of said aide lines of Berea Road and blest 117th Street; and bounded on the south by two lines drawn at right angles to Berea Road and CVest 117th Street, at a point 150 feet distant Yrom the point oY ix~teraection oY said .side Linea of Berea Road .and 14'est.117th Street; said Linea so drawn at right angles to be extended until they meet. The said area is to be excavated down from its present grade to the new grade oP Berea Road and Weat 11Tth Street, as the same shall be depressed and reconstructed, pursuant to the provisions of the grade elimi- nation ordiusnoe; and the elope connecting the depressed area with the natural surYaae of the ground to the south shall be at a grade of 1 Pt. ~ •ertical to 1.7 tt. horizontal. T. Said municipalities and railroad company, are, at their expense, to design and construct a highway bridge over Berea Road, the center line oP which shall be about 260 Peet distant westerly from the point oP inter- section of the center line oY Berea Road with west 117th Street; said bridge to become the property, and to be for the private use of The National Carbon Company, its successors and assigns. Said bridge shall be constructed of reinforced concrete and steel, supported at the street lines of Berea Road on concrete abutments. The vertical clearance between the under side oP " said bridge and Berea Road shall be 15 Peet. Said bridge shall be constructs " to carry 1 line of 20-ton trunks and a load oP 75 lbs. per square Yoot on the sidewalk area. The roadeay of said bridge shall be 12 feet in width in the clear, and in addition thereto there shall be a sidewalk 5 Peet in ` width on one side thereof. The bridge is to De designed by the City of Cleveland. In addition to the construction of said bridge, said municipalitie and said railroad company are to construct a roadway approach to said bridge Prom the new street connecting Berea Road with ~Yest 117th Street as pro- vided in paragraph 5. The roadway oP such approsah shall be 20 feet in width and widened to 25 Peet at the curve adaacent to the bridge. Said - roadway shall be paved with 8 inch concrete base, 1 inch sand cushion and 4 inch brick wearing surface. 8. The National Carbon Company la to furnish without charge the land necessary for the construction of the bridge over Berea Road and the approsah thereto, Prom the new street connecting Berea Road with West 117th Street hereinbeYore apeaiYied; and The National Carbon Company shall, at its own expense, move all buildings, and erect all necessary new foundations therefor, on the south aide oY Berea Road, owned by The National Carbon Company, and necessary to be moved to permit the construction oY the slopes, roadway and bridge hereinbefore provided. The land Furnished for the approach to the bridge over Berea Road shall remain the private property oY The National Carbon Company, its successors and assigns; and in the event that said bridge shall be some dangerous to the public using said Berea Road, then unless the same shall be repaired to the satiafaetion oP the City Engineer within a reasonable time, said municipalities shall have the right to remove said bridge and recover the costa of such removal iron The National Carbon Company, its aneeeasora and assigns. 9. In addition to the things to be done hereinbefore set forth, said municipalities and railroad company hereby agree to pay The National Carbon Company the sum of X77,250.00; and toward the payment oY the same and all other costa and expenses involved in this settlement, The New York Central Railroad Company will pay 65~ thereoY, the City of Cleveland will pay 17-1~2% end the City of Lakewood 17-1f2~, as their respective portions.
