feet, having s_eho~d ~5.?~ feet long, which shoed bears north 64u 44! 54" west and has an arc distance of 37.22 feet to s point~ thence north 86° east, parallel to Detroit Avenue a distance Of 97.84 feet to a point in the easterly line of Lot No. 1; thence south 00o 42' ~0" west in said easterly line 17.04 feet to the place of begimming. TO be used for highway purposes only and subject to the condi- tion that should said land thus conveyed, or any portion thereof, at any ti~e eesse to be used for highway purposes, then such portion not thus used shall revert to the said gun 0il Company, In eonsideration of the aforesaid eonveyance, the City Of ~akowood,~by its Mayor and Director of Public Works,, thereunto duly authorised by the Council of the City of' L~kewo~d, stipulates and agrees as follows= 1, TO proceed promptly with the widening of Detroit Avenue from Bunts ROad to Manor Park Avenue, the enti~e ex- pense of suoh wideni~g to be ~o~ne by the City of Lakewood without any cost to the said Sun 0il Company! and in the event that any assessments or s~eolal taxes shall at any time be levied agains~ the Sun 0il Company because of the widening of laid' thoroughfare the Said City of ~akewood shall pay to the 5un 0il Company an amount equal to the total;sum of assessments or special taxes thus levied. 2, The expense of paving Detroit Avenue as thus widened and of re-laying the sidewalks amd curbs and eonstructing the ramps or driveways from the new eurb line to the sidewalk level on the Detroit Avenue f~ontsge of the pro~erty owned by the ~un 0il Company at Detroit Avenue and Manor Park Avenue shall Be borne and paid in full by the said Clt~ of Bake~ocd. In addition to the foregoing eovena~ta and agreements, the~ndersigned, the City of.L~kewood~ for itself and its suecessors, as a part of the consideration for the conveyance of the above described parcel of land by the Sun 0il Company, agrees that so far as it shall be possible to do so, and unless prevented or otherwise ordered By a scurf of eompetent Juris- diction, the following things shall be done eoincident with the widening cf Detroit Avenue from Bunts Road to Manor Park AVenue as aforesaid=- A. There shall be trimmed the two trees or the overhanging branches of such trees located within the new tree lawn be- tween the new sidewalk line and the new curb line or within the new sidewalk area, as the same shall be established after ·aid widening, ln X~ront of the lot hitherto owned by Agnes A. May and adjoining on the easterly aide the property owned by the ~un 0il Company at the corner of Detroit Avenue and Ma~or P~rk Avenue, so that automobile drivers approaching said pro- perty from the east shall have a clear and unobstrncted vision of the station and signs of the Sun0il Company located on said corner. B. The northwest corner of the intersection of Detroit Avenue an~ Manor Park Avenue shall be set back at the sole expense of ~he City cf Lakcwood and the curb off such new oor~er shall be set on a curve substantially corresponding' with the inner walk now existing at such corner, as shown
