Hurd <br /> <br /> Am Ordinance to amend Section 21 of Ordinance No. 1786. entitled "An Ordinance <br />providing for the zoning or districting of the City of Lakewood and the regulation of <br />the location, bulk, height end uses of buildings and other struc%ures and premises, and <br />repealing Ordinance No. 1479", and to provide for ~he establishing of set-back lines in <br />any use district. <br /> <br />BE IT ORDAI~NED BY l~ COUNOIL OF T~l~ 0,ITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 21 of Ordinance No. 1786 entitled "An Ordinance providing <br />for the zoning o~ districting of the City of Lakewood and the regulation of ~he location, <br />bulk, height and uses of buildiugs and other structures and premises, and repealing <br />Ordi-A~ee No. 1479". which reads as folle~s. <br /> <br />Section 21. FRONT YARDS$ BUILDING LINES - For the purpose of establishing front yards <br />and for the purpose of further regulating side yards and the height of buildings <br />near the street line. building lines, as set forth on ~he building line map which <br />accompanies the ordinance a~d is hereby declared to be part hereof, are hereby es- <br />tablished. ~he map designations and the map designation rules which accompany said <br />map are hereby declared part thereof. Between a building line and the street line <br />no building or portion of a building, e~tending above the curb level, may be erected. <br /> <br />le RESIDENOE DISTRICTS - In a Class la or lb district where the location or,he <br />building line is not prescribed on the building line map. building lines are estab- <br />lished as follews: <br /> <br />(a) Om a street frentage on either side of a street where ~0%or more of such frontage <br />bet~reen ~wo intersecting streets, but excluding the frontage along the side line of a <br />corner lot or outside such Class la or lb district, is improved with buildings that are <br />set back from tho street line or where all the buildings though occupying less ~han <br />50%hut more than 20% of such frontage are set back from the street line. the align- <br />ment of the existing buildings shall be the building line. Minor irregularities in <br />such all,merit of existing buildings may be disregarded by the Board of Zoning Appeals <br />in defining and applying this building line regulation or said Board may. when in its <br />opinion the general purpose and intent of this paragraph will be better served there- <br />by. determine that the average distance the existing buildings are back from the <br />street line. either for such entire frontage or for any part thereof~ shall be the <br />building line. <br /> <br />(b) ~ a etree~c frontage on either side of a street between two intersecting streets, <br />but excluding the frontage along the side line of a corner lot or outside of such <br />Class la or lb district, where not more than20%of such frontage is ~w?rovedwith <br />buildings that are built at the street line and where the provisions of paragraph <br />(1) of this section do not create a building line, the distance of the building line <br />back f~emthe street line shall be 20%. of the average or normal depth of the lots <br />having their front lines along such street frontage but such distance back from the <br />street line need not be more than 30 feet. Where in any portion of such street <br />frontage there are lots of markedly less depth than the normal, the Board of Zoning <br />Appeals in defining and applying this building line regulation, may, when in its <br />opinion the general purpose and intent of this paragraph will be better served ~hereby, <br />divide such street frontage into Sections for the application of the above 20%building <br />line requirement. <br /> <br />(o) Along the side line of a corner lot the distance of the building back from the <br />street line shall be 10% of the average width of such lot, but such distance back <br />from the street line need not be more than 10 feet. No buildinE line shall be re- <br />quired along the side line of a corner lot where the rear of such lo~ adjoins a <br />street ~rontage along which no building line is required by ~hie ordinance. <br /> <br />2, APPEALS -Whenever any parcel of land now separately owned ~dwhichwas so ~w~ed <br />prier to the passage of this ordinance is of such rsstrieted area that it ca~ct be <br />appropriately improved without building Beyond the building line established by this <br /> <br /> <br />
