A <br /> e <br /> ORDINANCE N0. 4023. by Mr. Fahrenbach <br /> AN EMERGENCY ORDINANCE authorizing blackouts; authoriz- <br /> ing the Mayor to prescribe such orders, rules and regulations <br /> pertaining thereto as may be necessary to ensure the success of <br /> blackouts; and prescribing penalties for the violation thereof. <br /> WHEREAS, the United States of America is now engaged in <br /> a War with foreign powers and the defense of our Nation is in the <br /> hands of our Military and Naval forces; and <br /> 4VfiEREA5, in modern warfare no city, however distant from <br /> the enemy, 3s free from attack; and <br /> WEEREAS, lights at nighttime are a definite aid to the <br /> enemy in reaching military and other objectives; and <br /> VsrHEREAS blackouts, when ordered by the Military and <br /> Naval forces are essential to the preservation of life and property <br /> _ in this city, and it is imperative that the City of Lakewood aid the <br /> armed forces by all possible co-operation and assistance, and <br /> P,~3E'REAS, failure to extinguish lights when ordered to do <br /> <br /> ' so by duly authorized authorities may result in loss of life of th e <br /> • residents of the City of Lakewood as well as the residents of other <br /> parts of the Nation when our lights are used as a guide to other <br /> objectives;' and <br /> P,IiEREAS, this ordinance constitutes an emergency for th e <br /> reasons hereinbefore stated and in that it provides for the immediate <br /> preservation of the public health, prop arty and safety and for the <br /> usual daily operation of a municipal department, now therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAE~VJOOD, <br /> STATE OF OHIO: <br /> Section 1. In order to protect life and prop arty in the <br /> City of Lakewood from enemy action the mayor is authorized and directec <br /> to carry out blackouts in said city at such times and for sucn period <br /> as are ordered by the Rilitary and Naval forces and the Pitayor is <br /> authorized and directed to prescribe and publish such orders, rules <br /> and regulations as may be necessary to ensure the success of the black• <br /> outs and to protect life and property during said periods; <br /> Section2.. The l.ayor may appoint for a specified time <br /> as many special police, without pay, from among residents of the City <br /> of Lakewood as reay be deemed advisable for service in connection with <br /> any blackout. During the term of service of such special police, <br /> they shall possess all the powers and privileges and perform all. the <br /> duties of privates in the standing police force of the City of Lakewooc <br /> Said special police must wear such identifying emblem as may be <br /> prescribed by the t::ayor and it shall be unlawfS~:I.for any said special <br /> policeman to attempt to carry out any order, rule or regulation <br /> promulgated under the authority conferred by this ordinance when he is <br /> not. wearing said identifying emblem. <br /> Section 3. The City of Lakewood shall not be liable for <br /> any damage sustained to person or property during, or as the result of, <br /> an authorized blackout. <br /> Section 4. When deemed necessary in order to protect life <br /> or property during a blackout the police, or the special police <br /> authorized herein, are authorized and directed to enter upon any <br /> premises within the City of Lakewood and extinguish lights or take <br /> other necessary action to make effective any order, rule or regulation <br /> promulgated under the authoAty conferred by this ordinance. <br /> <br />
