BY Mr. Fahrenbach <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City of Lake- <br />wood to enter into an agreement with the City of Rocky River authorizing exchange <br />of fire department service. <br /> <br /> ~HEREAS, an emergency exists in that the agreement heretofore entered into with <br />Rocky River expired on or about May 1, 1948, necessitating a new agreement to be <br />entered into forthwith if the exchange of fire department service is to be continued, <br />and in that it provides for the public health, welfare and safety and the usual daily <br />operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWO~, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby, authorized to enter into an <br />agreement on behalf of the City of Lakewood with the City of Rocky River providing <br />for the exchange of fire department service, said agreement to provide substantially <br />as follows: <br /> <br />"THIS AGR~:~NT entered into this day of , 1948, <br />by and between the City of Lakewoo~-~o, party' ~of the First Part, <br />and the City of Rocky River, Ohio, party of the Second Part, <br /> <br />WI TNES SE TH: <br /> <br />"WHEREAS, the parties hereto are adjacent municipalities having a common <br />bou~wyline; and <br /> <br />"W~EEEAS, each party maintains and operates a Fire Department; and <br /> <br />"WHEREAS, General Code of Ohio, Section 3298-60, authorizes muni- <br />cipalities to enter into such agreements: <br /> <br />"NOW, THEREFORE, in consideration of the benefit whichwill inure <br />to each partyfrom the greater security and safety to the property <br />and lives of its citizens by reason of this agreement, and the ser- <br />vice hereby authorized, it is mutually agreed as follows: <br /> <br />#1. In the event of an~unusual fire creating an emergencywitb~ <br />the jurisdiction of either party hereto, such party may call upon <br />the Fire Department of the other party for assistance and se~-vlce, <br />it being agreed that the party so called upon shall give such assis- <br />tance and service in so far as is possiblee <br /> <br />"2. This agreement for the exchange of Fire Department service shall <br />be in full force and effect for a term of three years ending April 30~ <br />1951, provided, however, that this agreement and the Fire Department <br />service herein agreed upon may be termi~ated by either party hereto <br />upon ~inety (~0) days w~itten notice to the other party. <br /> <br />"IN WITNESS WHEREOF the parties hereto have set their hands and <br />official seals t~ duplicates hereof as of the day and year first <br />above written; the City of Lakewood by its Mayor, duly authorized <br />by Ordinance No~ , adopted by the Council of the City of <br />Lakewood on ...... , and the City of Rocky River <br />by its Mayor and Safety-Service Director, duly authorized by <br />Ordinance No~ , adopted by the Council of the City of Rocky <br />River on . <br /> <br />CITY OF LAKEWOOD <br /> <br /> MaYOr <br />Party of the First part <br /> <br />CITY OFROCKYRIVER <br /> <br />BY <br /> ~a~or ~a~e~y-~ervmce Dmrector <br /> Party of the Second Part <br /> <br /> <br />
