ORDINANCE NO. <br /> <br /> 4657 BT Mr. Vickery <br /> <br /> An ordinance to create unifOrmity among departments as to concmtmons <br /> and terms of employment of hourly paid workers, especially in regard to <br />~overtime compensation, holidays, vacations and sick leave. <br /> <br /> Whereas, there exist differences between the various departments <br /> ~nd divisions of the City of Lakewood in their policies regarding the <br /> employment of hourly paid workers as to overtime compensation, holidays~ <br /> vacations, ~ick leave and.work weeks, by reason of which unjust discrimi- <br /> natmons agamnst hourly pamd workers Have occurred; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAK~OOD~ STATE OF OHIO: <br /> ~ec~ig~ 1. Definitions. <br /> <br /> (a) For all purposes of this.ordinance the term hourly employee <br /> is defined to include and to be limited to all persons Who furnish labOr <br /> or personal service to the City of Lakewood and are compensated therefor <br /> by wages fixed, computed or paid on an hourly basisand paid directly by <br /> said City~ except employees who furnish labor to the City Hospital and are <br /> compensated from the Hospital Fund. <br /> <br /> (b) The term week is defined as the period beginning at 12:O1 A. <br /> Monday and~ending at 1-2-~0 midnight the following Sunday. <br /> <br /> (c) The term work week is defined to be the period in a week during <br /> which hourly employees shall be available for work, It regularly shall be <br /> within the period from 8:00 A. M. ~londay to 12:00 noon the following Satur- <br /> day. It shall be forty-four (44) hours except that in any week in which <br /> there occurs a holiday as hereinafter defined it shall be thirty-six (36) <br /> hours. Nothing herein contained shall be construed to limit the power of <br /> the City as employer to require overtime labor wheh necessary. <br /> <br /> (d) The term work day is defined as the period in any day during <br /> whic~ hourly employse~ shall be available for wor~. It regularly shall <br /> be emght (8).hours mn e~ch consecutiVe twenty,fou~ (24) hour permod from <br /> Monday to Friday, both inclusive, and fo~r.(4) hqUrs on Saturdays. Nothing <br /> heremn contamned shall be construed to limmt the power of the City as <br /> employer to require overtime labor when necessary. <br /> <br /> (e) The term full tmme perman.e~ot hourlyemployee is defined to <br /> mean an hourly employ~ewho has serve~ the CitM fulI ti~e at least twenty- <br /> six (26) consecutive weeks. <br /> (f) The term division head is defined to mean the person who is <br /> in charge of the oper~tibn Of ~ny division named in the charter of the City <br /> the work of which is perfozm~ed in any part by one or more hourly employee~. <br /> <br /> (g) The term regular time is defined to mean the rate of pay fo~ <br /> workperfOrmed by an hourly employee during a work week and during a wc~k <br /> day. <br /> <br /> (h) The term overtime is defined to mean the rate of pay for work <br /> performed by an hourl~ee in excess of a work day or a work week, or <br /> for work performed by such employee on Saturday afternoon~ on Sunday, or on <br /> any holiday as hereinafter defined. <br /> <br />Section 2. Guaran%eed ~'~rk Week. <br /> <br /> ' Full time permanent hourly employees~ if available and willing to <br />Work, shall be and hereby are guaranteed employment for a minimum of forty <br />(40) hours per week, and in fulfillment of such guarantee will be ~aid a <br /> <br /> <br />
