<br /> AN Ei~HGENCY ORDINANCE prohibiting gambling, the possession of
<br />gambling devices and the ownership or keeping of places for gambling;
<br />prohibiting the possession of tickets for lottery; prohibiting the
<br />printing, possession or sale of lottery tickets and gambling devices;
<br />providing penalties for violation; and repealing Ordinance No. 3612
<br />and Ordinance No. 2512.
<br />
<br /> WHEREAS, an emergency exists in that lottery and gambling schemes
<br />are becoming prevalent requiring immediate protection to citizens of
<br />the City of Lakewood and in that this ordinance provides for the public
<br />welfare and safety and for the usual daily operation of a municipal
<br />department, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF
<br />OHIO:
<br />
<br /> Section 1. That it shall be unlawful to keep a room, building,
<br />arbor, booth, shed, tenement or other building to be used or occupied
<br />for gambling, or knowingly permit it to be used or so occupied, or
<br />being the owner thereof, to rent it to be so used or occupied.
<br />
<br /> SeCtion 2. Any owner of such building or other property, as
<br />provided in the next preceding section, knowing that a device is kept
<br />therein for gambling, who.does not forthwith make a complaint against
<br />the person so using or keeping it, shall be deemed to have knowingly
<br />permitted it to be used and occupied for such purpose.
<br />
<br /> Section 3. That it shall be unlawful to permit a game to be
<br />played for gain upon or by means of a device or machine in any house,
<br />outhouse, booth or erection of which any person has the care or pos-
<br />session; provided further, that it shall be unlawful to play any game
<br />for gain upon or by means of any device or machine.
<br />
<br /> Section $. That it shall be unlawful to keep or exhibit for
<br />gain or to win money or other property, a gambling table, or faro or
<br />keno or bingo bank, or a gambling device or machine, or to keep or
<br />exhibit a billiard table for the purpose of gambling or to allow it to
<br />be so used.
<br />
<br /> Section 5. That it shall be unlawful to place any wager or bet
<br />upon the outcome of any game being played on or with any device or
<br />machine or in any building or place named in the preceding sections.
<br />
<br /> Section 6. That it shall be unlawful to keep a room or building,
<br />or portion thereof, or to occupy public or private grounds with appara-
<br />tus, books or other device for recording wagers or selling pools, or
<br />to record wagers or sell pools upon the result of a trial or contest
<br />of skill, speed or power or endurance of man or beast, or being the
<br />owner, lessee or occupant of such room, building or portion thereof,
<br />knowingly permits it to be so used or occupied, or keeps, exhibits or
<br />employs therein a device or apparatus for recording such wagers, or
<br />for selling such pools, or becomes the custodian or depository for
<br />hire or reward of money, property or other thing of value so staked,
<br />wagered or pledged.
<br />
<br /> Section 7. That anyone who plays any game with cards or dice
<br />or other gaming device in any poolroom, dance hall, retail store or
<br />other public place, or upon any lot or inclosure, where the public may
<br />be annoyed thereby, or whoever being the owner or lessee or occupant
<br />of any such place of business or lot or other inclosure, permits an-
<br />other to play such game, shall be guilty efa misdemeanor.
<br />
<br /> Section 8. It shall be unlawful for any person to vend, sell,
<br /> barter or dispose of a ticket, order or device for or representing a
<br />number of shares or an interest in any lottery, bingo, keno, or scheme
<br />
