of chance, by whatever name,style or title denominated or known, whether
<br />located or to be drawn, paid or carried on within or without the City
<br />of Lakewood.
<br />
<br /> Section 9. It shall be unlawful for any person to vend, sell,
<br />barter or dispose of a ticket, order or device for or representing a
<br />number of shares or an interest in a scheme of chance known as "policy",
<br />"numbers game,, "clearing house", "bingo", "keno", or by words or terms
<br />of similar import, whether located or to be drawn, paid or carried on
<br />within or without the City of Lakewood.
<br />
<br /> Section lC. It shall be unlawful for any person to establish,
<br />open, set on foot, carry on, promote, make, draw or act as "~eker" or
<br />"vendor" for or on account of any lottery, policy, bingo, keno or
<br />scheme of chance by whatever name, style, or title denominated or known.
<br />
<br /> Section ll. It shall be unlawful for any person to print, write
<br />or publish, to have in his possession, or in his custody, or under his
<br />control, any ticket, check, writing, slip, paper or document, which
<br />represents or is a memorandum of, or is evidence of, or is intended to
<br />be used as a memorandum or evidence of, or which is designed or in-
<br />tended to be used in the process of making, settling, paying, register-
<br />ing, evidencing, or recording, a number of shares or an interest in
<br />any lottery, 'policy', bingo, keno, or ether scheme~of chance, by what-
<br />ever name, style, or title denominated or known, whether located or to
<br />be drawn, paid or carried on within or without the City of Lakewood.
<br />
<br /> Section 12. Any person violating any of the provisions of
<br />Sections i to ll, inclusive, of this ordinance shall be guilty of a
<br />misdemeanor and upon conviction shall be fined in any sum not less than
<br />twenty-five dollars ($25.00) nor more than five hundred dollars (~500.00),
<br />or imprisoned not less than thirty (30) days nor more than sixty (60)
<br />days, or both.
<br />
<br /> Section 13. It shall be unlawful for any person to keep, ex-
<br />hibit or maintain for gain or cause or permit to be exhibited or main-
<br />tained for gain in the City of Lakewood, any machine, device or instru-
<br />ment which may be operated by the use of a coin, token, slug, disk,
<br />marble, ball or puzzle, whether said machine, device or instrument pur-
<br />ports to vend or distribute merchandise, or to furnish recreation or
<br />amusement, if said machine, device, or instrument when so operated,
<br />returns or distributes more or less merchandise than it purports to re-
<br />turn or distribute, or returns or distributes one or more coins, tokens,
<br />slugs, disks, marbles, balls or other article, or if such machine or
<br />device, when used or played, records or tabulates a score, number or
<br />mark, which is used for obtaining merchandise or other articles. A~y

<br />vlolatmon of th~s section shall be punishable, upon convict , by a
<br />fine not exceedmng one hundred dollars (~lO0.O0) and each day's exhibition
<br />or maintenance of such machine shall constitute a separate offense.
<br />
<br /> Section 14. The provisions of the several sections and the sep-
<br />arate sections of this ordinance are hereby declared to be separate and
<br />distinct provisions and sections and any holding that any provision or
<br />section hereof is unconstitutional or otherwise void, shall not affect
<br />the validity of the other provisions or sections of this ordinance.
<br />
<br /> Section 15. This ordinance is hereby declared to be an emer-
<br />gency measure for the reasons stated in the preamble hereof and, pro-
<br />vided it receives the affirmative vote of two-thirds of all members
<br />
