Section 1tl, Every person convicted ®r found guilty of a misdemeanor for a vio-
<br />lation of any of the provisions of this ordinance for which another penalty is not
<br />provided shall, for a first offense thereof, be fined not more than $50.00; and for a
<br />second effense %~thin one year thereafter, not less than $10.00 nor more than $100.OO,
<br />or imprisoned in the city jail, county jail or workhouse not more than ten days, or
<br />both; and for a third or subsequent offense ~.~h~n one yee~r after the first effense
<br />shall be fined not less than $25.00 nor more than $200600 or imprisoned in the city
<br />jail, county jail or workhouse not more than thirty days or both, provided, further,
<br />that when any person is found guilty of a first offense for a violation of Sectionl6
<br />of this ordinance upon a finding that he operated a motor vehicle faster than thirty-
<br />five miles an hour in the business districts of Lak~wood or faster than fifty miles
<br />an hour in other portions, or faster than thirty-five miles an ho%~r while passiug through
<br />a school zone during recess or while children are going to or leaving school during
<br />the opening or closing hours, the court may, in addition ~o the penalty herein provided,
<br />sentence such offender to the city jail, county jail or workhouse for not more than
<br /> five days. ~ ~ ~ ~
<br /> Section 112. Whoever violates any of the provisions of Section 57 to Section
<br /> 57-11~ inclusive, upon signing a waiver may be fined in the sum of One Dollar if the
<br /> defendant presents himself and pays said' fine at the Traffic Bureau within 48 hours;
<br /> if said fine is not paid within 48 hours, but before 72 hours has elapsed, he shall
<br /> be fined in the sum of Two Dollars and if said fine is not paid within 72 hours,
<br /> application shall be made for a warrant and the fine may be in any sum not less than
<br /> Two Dollars and not more than Ten Dollars~
<br /> Section ll3. %~hoever resi~s, hinders, Obstructs or abuses ar~r police officer
<br /> while attempting to arrest offenders under any of the provisions of this ~rdinance~
<br /> or interferes in shy way with any person charged ~nder the provisions of this ordi-
<br /> nance, with the enforcement of the provisions thereof, shall be fined not more than
<br /> Fifty Dollars, nor less than Ten Dollars.
<br /> Section llk. In the event of the amendment or repeal of any section or sections
<br /> of this ordinance, such amend~ment or repeal shall in no manner affect any pending
<br /> action, prosecution or proceeding, civil or criminal and such amendment or repeal
<br /> shall not affect causes of action, prosecution or proceeding existing at the time of
<br /> such amendment or repeal unless otherwise expressly provided in the amending or
<br /> repealing act.
<br /> Section 115. Each section or part of this ordinance shall be deemed to be an
<br /> independent section or part, and if any section or part of this ordinance shall be
<br /> held to be invalid for any reason, it shall not affect any other section or part
<br /> hereof.
<br /> Section ll6. This ordinance shall take effect ~ud be in force from and after
<br /> its passage ~ud approval by the Mayor at the earliest period allowed by law, and
<br /> Ordinances 4060, 4074, ~440, ~454, 4471, 4474, 4500, 4565, 4629, 4637, 46~3, 4695,
<br /> 4697, 4756, 4774, 4775, and a3_l other ordinances or parts of ordinances inconsistent
<br /> herewith, shall be and are hereby repealed.
