ORDINANCE NO. 4834 BY Mr, Vickery <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City of <br />Lakewood to enter into an agreement wlth the Board of County Commissioners of <br />Cuyahoga County for the resurfacing of Hilliard Road from Madison Avenue to <br />Riverside Drive. <br /> <br /> WHEREAS, an emergency exists in that on , this Council <br />adopted Ordinance No. consenting to the improvement of Hilliard Road, with <br />which improvement it is necessary to proceed during seasonable weather, and in <br />order to provide for the public health, welfare and safety and the immediate oper- <br />ation of a municipal department, now~ thereforee <br /> <br />BE IT ORDAINED BY THE COUNCIL OF T~L~ CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be, and he is hereby, authorized on behalf of <br />the City of Lakewood to enter into an agreement with the Board of County Commis- <br />sioners of Cuyahoga County for the resurfacing of Hilliard Road from Madison <br />Avenue to Riverside Drive in the manner as indicated on plans prepared bythe <br />City and County Engineers and approved by the County Engineer under date of <br /> · which agreement shall be substantially as follows: <br /> <br /> "Agreement between the Board of County Commfssioners of Cuyahoga County, <br /> Ohio, and the City of Lakewood for the improvement of Hilliard Road <br /> from Madison Avenue to Riverside Drive~ <br /> <br />..Thi~~ a~eemen~ entered into on the day of , 1952, <br />by and between the County of Cuyahoga,-~-~'-its Board of County Commission- <br />ers, Party of the First Part, and the City of Lakewood, by its Mayor· <br />having been duly authorized to enter into said Agreement by Ordinance <br />No. , adopted by the Council of the City of Lakewood on the <br />day o-~ , 1952, Party of the Second Part. <br /> <br />"WITNESSETH: <br /> <br />"Whereas, the Board of County Commissioners of Cuyahoga County and the <br />Council of the City of Lakewood, by its Ordinance of Consent No. , , <br />adopted on the day of , 1952, have mutually <br />agreed by and be-'t-w~ themselves to improve Hilliard Road, a County Road· <br />within the City of Lakewood, from Madison Avenue to Riverside Drive· by <br />resurfacing as per plans and specifications prepared therefor; and, <br /> <br />"Whereas, the Board of County Commissioners of Cuyahoga County has agreed <br />to improve the before mentioned road. <br /> <br />.NO¥4 THEEEFORE, inconsideration of the covenants and agreements herein <br />contained to be performed by the parties hereto and the payment herein- <br />after agreed to be paid, it is mutually agreed by and between the parties <br />hereto as follows: <br /> <br />.First - <br /> <br />That the Party of the First part will improve Hilliard Road, <br />a County Road· between the limits hereinbefore set forth, <br />in accordance with the plans, specifications and estimates, <br />prepared therefor. <br /> <br />.Second - <br />.Third - <br /> <br />That the Council of the City of Lakewood does hereby approve <br />said plans, specificationS and estimates. <br /> <br />The engineering expense of said improvement shall be divided <br />as follows: <br /> The City of Lakewood shall make the necessary preliminary <br /> s~rveys and prepare the plans; and the County of Cuyahoga <br /> shall furnish the personnel and bear the expense of all <br /> construction engineering, including layout~ supervision <br /> and inspection, <br /> <br /> <br />
