"Fourth - <br /> <br />"Fifth - <br /> <br />"Sixth <br /> <br />"Seventh <br /> <br />"Eighth - <br /> <br />"IN WITNESS <br />the day and <br /> <br />WIT~ESSES: <br /> <br />That the total cost of the improvsment shall be the actual <br />amount paid to the contracter for construction of the road <br />as indicated on the approved plans and as determined by the <br />final estimate. <br /> <br />That the total cost of said improvement shall be divided as <br />follows: <br /> The City of Lakewood shall pay fifty percent (50%) of <br /> the actual cost of that portion cf said improvement as <br /> defined in the fourth paragraph above, and the County <br /> of Cuyahoga shall pay the balance of the cost of said <br /> improvement. <br /> <br />That the City of Lakewood shall pay into the Treasury of <br />Cuyahoga County, fifty percent (50%) of the Engineer's <br />Estimate of the cost prior to the award of a contract by <br />~the Board of County Commissioners ofCuyahogaCounty, for <br />said improvement. <br /> <br />That upon completion of the improvement and payment of the <br />final estimate thereof, the County of Cuyahoga shall refund <br />to the City of Lakewood a sun equal to the difference be- <br />tweenthe amount paid into the Treasury of Cuyahoga County <br />by the City of Lakewood and fifty percent of the actual <br />cost of the improvement as determined bythe final estimate <br />paid to the contractor. ~ <br /> <br />That the City of Lakewood further agrees t~ maintain the <br />completed road in a satisfactory manner. The County Engineer <br />will make periodic inspections and will notify the City as <br />to any necessary repairs which are required to keep the road <br />in serviceable condition. The City agrees to make such <br />repairs promptly when notified by the County Engineer that <br />such repairs are necessary. The City also agrees that if <br />it fails to make the necessary repairs within a reasonable <br />time after receiving notice from the County Engineer, that <br />the County is authorized to proceedwith the repair work <br />and the City agrees to reimburse the County for any and <br />all expense incurred by the County, in the making of said <br />repairs. <br /> <br />WHEREOF, the parties hereto have affixed their signatures <br />year mentioned above. <br /> <br />BOARD OF COUNTY COMMISSIONERS <br />CUYAHOGA COUNTY, OHIO <br /> <br />CITY OF LAK~VOOD, OHIO <br /> <br />Mayor <br /> <br /> Section 2~ That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br /> <br /> <br />
