<br /> AN EMERGENCY ORDINANCE authorizing the Mayor, as Director of Public
<br />Works, on behalf of the City of Lakewood, to enter into an agreement
<br />with the Brown Construction Co., an Ohio corporation, for the construc-
<br />tion of a municipal departments and administration building at 12650
<br />Detroit Avenue, Lakewood, Ohio.
<br />
<br /> WHEREAS, An emergency exists in that provisions should be made
<br />for the construction of a municipal departments and administration
<br />building, and in that this ordinance provides for the immediate pres-
<br />ervation ef the public peace, property, health or safety, or for the
<br />usual daily operation of municipal departments, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE
<br />OF OHIO:
<br />
<br /> Section 1. That the Mayor, as Director of Public Works, is here-
<br />by authorized and directed, on behalf ef the City of Lakewood, to enter
<br />into an agreement with the Brown Construction Co., an Ohio corporation,
<br />for the construction of a municipal departments and administration
<br />building at 12650 Detroit Avenue, Lakewood, Ohio, which said agreement
<br />shall read substantially as follows:
<br />
<br />"THIS AGREEMENT MADE and entered into this day of June, 1958,
<br />by and between the City of Lakewood, State of Ohio, hereinafter
<br />called "City", and the Brown Construction Co., an Ohio corpora-
<br />tion, hereinafter called "Contractor", for the construction of
<br />a municipal departments and administration building at 12650
<br />Detroit Avenue, Lakewood, Ohio,
<br />
<br />WITNESSETH
<br />
<br />That pursuant to authority of Council, City advertised for bids
<br />for the construction of a municipal departments and administra-
<br />tion building in Memorial Park, 12650 Detroit Avenue, Lakewood,
<br />Ohio.
<br />
<br />That at 12:00 o'clock noon, eastern daylight saving time, Wednes-
<br />day, April 30, 1958, bids were received and publicly opened, and
<br />Contractor submitted a base bid of $1,379,990.00 for the erection
<br />of such structure, and that in addition to such base bid, Con-
<br />tractor submitted a bid on the following alternates listed in
<br />specifications as:

<br />making a total bid in the amount of $1,$17,$20.00, and such bid
<br />was accepted by the Council of the City, and thereafter the Council
<br />authorized the Director of Public ~Jorks to enter into an agreement
<br />with Contractor for such construction for the amount of $1,417,$20.O0.
<br />
<br />That Contractor has agreed, and by these presents does agree, with
<br />City, for the consideration hereinafter named, to furnish all ma-
<br />terial and do all the work, of whatever kind necessary, to com-
<br />plete the said municipal departments and administration building
<br />in a good, substantial and workmanlike manner, ready for use, and
<br />in strict accordance with the specifications heretofore provided
<br />therefor, and attached hereto, and according to plans, profiles
<br />and drawings listed in said specifications, and in accordance with
<br />Contractor's proposal accepted by the City.
