ORDINANCE NO. 92-58 <br /> <br />BY~ Messrs. Law, her, Ward, <br /> Chockley, Fahrenbach, <br /> Gaydos, Gottermeyer. <br /> <br /> AN EMERGENCY ORDINANCE giving consent to Cuyahoga County for the <br />improvement of Lakewood Heights Blvd. and Berea Road by the construction <br />efa grade separation at the tracks of the New York Central Railroad <br />and the Cleveland Transit System Rapid Transit Line. <br /> <br /> WHEREAS, The Board of County Commissioners has tentatively ap- <br />proved a construction program for the year 1958, and <br /> <br /> WHEREAS, Lakewood Heights Blvd. and Berea Road, the streets to <br />be improved, are City streets and County roads lying between the limits <br />indicated on construction plans heretofore delivered and approved by <br />Narlan F. Bartels, Lakewood City Engineer, and <br /> <br /> WHEREAS, This ordinance provides for the immediate preservation <br />of the public peace, property, health or safety and the usual operation <br />of a municipal department, now, therefore, <br /> <br /> BE IT ORDAINED GY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br /> Section 1. That it is hereby declared to be in the public in- <br />terest to consent to the said improvement, and that such consent is <br />hereby given for the improvement of the above mentioned streets between <br />the termini designated on said construction plans and in accordance <br />therewith. <br /> <br /> Section 2. It is hereby declared that the improvement is of suf- <br />ficient interest to the City and that the City shall perform, at no <br />cost to Cuyahoga County, all work specified in Section 5, Paragraphs <br />A, B and C of the agreement pertaining to this project and among <br />Cuyahoga County, the City of Lakewood, the New York Central Railroad <br />and the Cleveland Transit System, plus the entire cost of re-locating <br />its owned and operated utility installations; which cost of re-loca- <br />tion is included in the construction contract for the grade separation <br />project and shall be performed thereunder. <br /> <br />That such Section 5, Paragraphs A, B and C provide as follows: <br /> <br />(A) <br /> <br />Removal and replacement as necessary of the structures or <br />facilities of all public utilities, however owned, includ- <br />ing municipally owned power lines, water mains, ~ervice <br />lines, fire hydrants, valve boxes and water servmce con- <br />nections to abutting property, and including sanitary <br />sewers or other publicly owned facilities of whatever <br />nature occupying the highway or streets within the city <br />limits, coordinating such work with construction activ- <br />ities so as to avoid delays to the contractor <br /> <br />(B) Designation and maintenance of necessary highway detours <br /> on existing city streets. <br /> <br />Provision of all material and labor required for the in- <br />stallation or relocation of any street lighting system <br />deemed necessary by each City, over and above the work <br />included in Paragraphs A-12 and B-10, Section i of this <br />agreement. <br /> <br /> <br />
