ORDINANCE NO. 45-59 BY: Messrs, <br /> <br />Ward, Fahrenbach, <br />Fairgrieve, Gaydos, <br />Gottermeyer, Lawther~ <br /> <br /> AN ORDINANCE to amend Section 1113.02 of the Zonin~ Cod~ <br />of the Codified Ordinances of the City of Lskewood to provide <br />for an increase in off-street parking facilities required in a <br />lb District. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Section 1113.02 of the Zoning Code of <br />the Codified Ordinances of the City of Lakewood, now reading: <br /> <br />~'1113o02 Apartment House. <br /> <br />In a Class lb district no building or premises shall be <br />used and no building shall be erected which is arranged, <br />intended or designed to be used for a Class 2a, 2b, 3a, 3b <br />or 3c use. In a Class lb district no building or prem- <br />ises shall be used, and no building shall be erected <br />which is arranged, intended or designed to be used ex- <br />cept for a Class la or lb use. No apartment house shall <br />be erected in any residence, retail, commercial or in- <br />dustrial district, nor shall a permit be granted for the <br />erection of any such building unless the plans provide <br />for, and the building is so erected as to provide for, <br />at least one garage or parking space within said build- <br />ing or on said premises sufficient in size to permit <br />the parking of one motor vehicle for each apartment in <br />said building.,, <br /> <br />shall be and is hereby amended to read as follows: <br /> 1113.02 Apartment House. <br /> <br />In a Class lb Use District no building or premises shall <br />be used and no building shall be erected which is ar- <br />ranged, intended, or designed to be used for a Class <br />2a, 2b, 3a, 3b or 3c use~ In a Class lb Use District no <br />building or premises shall be used, end no building <br />shall be erected which is arranged, intended or designed <br />to be used except for a Class la or lb use. An apart- <br />ment house shall not be erected in any residence, retail, <br />commercial or industrial district, and a permit shall <br />not be granted for the erection of any such building un- <br />less the plans provide for, and the building is so <br />erected as to provide for, the accessory off-street park- <br />ing facilities as herein required and regulated. <br /> <br />1. Off-street Facilities Required - Accessory off-street <br />parking facilities shall be provided as a condition pre- <br />cedent to occupancy of an apartment house whenever a <br />new building is constructed, and whenever an existing <br />building is altered so as to increase the nUmber of <br />dwelling un~, facilities shall be provided for the ex- <br />isting building as well as for the addition. All re- <br />quired off-street oarking facilities shall continue un- <br />obstructed in operation, and shall not be reduced to less <br />than the total number of spaces reeuired as long as the <br />main use prevails unless an equivalent number of spaces <br />are provided in another location or locations approved <br />by the Lakewood Planning Commission. <br /> <br /> <br />
