<br /> AN~RGENCY ORDINANCE authorizing the Mayor, ex-officio Direc,
<br />for of Public Works, on behalf of the City of Lakeweod, to enter into
<br />an agreement with the Soceny Mobil Oil Company, Inc. relative to the
<br />use of its tank, pump and gear oil unit te dispense petreleum products
<br />for use by municipally owned vehicles.

<br /> ~EREAS, This ordinance provides for the usual daily operation
<br />of a municipal department, now, therefore,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE
<br />OF OHIO:
<br />
<br /> Section 1. That the Mayor, ex-officio Director of Public
<br />Works, is hereby authorized and directed, on behalf of the City of
<br />Lakewood, to enter into an agreement with the Socony Mobil Oil Company,
<br />Inc. relative to the use of its tank, pump and gear oil unit te dis-
<br />pense petroleum products for use by m~uicipally owned vehicles, which
<br />said agreement shall read substantially as follows:

<br />"Contract made 19m between Socony Mobil
<br />0il Company, Inc., having an office at 903 W. Grand Blvd.,
<br />Detroit 32, Michigan, hereinafter called Company, and City
<br />of Lakewood, jointly a~d severally if more than one, herein-
<br />after called Borrower, having a place of business at Municipal
<br />Bmilding, Lakewood, Ohio, hereinafter called the premises.
<br />
<br />Borrower is the owner of premises at Detroit & Alameda Ave.,
<br />in the City of Lakewood, County of Cuyahoga, State of Ohio.
<br />
<br />At Borrower's request, Company, without obligation to make
<br />replacements, lends to Borrower the following equipment.
<br />Additional loaned equipment shall be covered hereby.
<br />

<br />The foregoing list of equipment includes all equipment loaned
<br />to Borrower by Company, located at the above premises, under
<br />any and all other Equipment Agreements. As te all such equip-
<br />ment the provisions of this agreement shall govern.
<br />
<br />The provisions on the reverse side are made a part hereof.
<br />This instrument contains the entire agreement covering the sub-
<br />ject matter. Company's right to require strict performance
<br />shall not be affected~by any previous waiver or course of
<br />dealing.
<br />
<br />1. Borrower, if not the owner ef the premises, shall proc~re
<br />the owner's signature to the consent appended to this contract.
<br />Company may at any time enter upon the premises to remove any
<br />of the equipment or to exercise any other right hereunder.
<br />
<br />2. With respect to the equipment, Borrower shall ~a) pay
<br />promptly all taxes amd fees thereon and on all theinstallatien
<br />and use thereof, (b) keep it in good repair, (c) make no addi~
<br />tions thereto or alterations therein witheut Comp~uyts written
<br />
