B~rrower shall indemnify Company against all losses and <br />claims (including those of th? parties, their agents and em7 <br />ployees) for death, personal ~njury or property damage arising <br />out of the use or condition of the premises or the equipment, <br />or the presence or handling of products on the premises or in <br />the equipment, regardless of any defects therein. Company <br />does net warrant er guars~ntee the equipment. <br /> <br />4. This contract shall centinue until terminated by either <br />party by written notice tc the ether. Any assigr~ent of this <br />contract by Borrower without Company's written consent shall <br />be void. <br /> <br />5- On the termination of this contract for any reason, <br />Borrower shall promptly ret~n the esuip~ent to 9ompa~y. If <br />not so returned, Company may remove ~t wzthout l~ablllty, <br />without prejudice to other rights cr remedies and without <br />obligation to restore the premises te their former condition <br />or to repair or pay for damage incidental to removal, or <br />Company may abandon all or a~y part thereof." <br /> <br /> Section 2. This ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof, and provid- <br />ed it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor° <br /> <br />Adopted: December 7, 19~9 <br /> <br />Thomas C.
