AS AMENDED - Meeting April 19, 1965 <br /> Meeting May 3, 1965 <br /> <br />ORDINANCE NO. 33-65 BY: Messrs. Gaydos, Usher, <br /> Ward, Wendling. <br /> <br /> AN E~ERGENCY ORDINANCE authorizing the Mayor to enter into <br />a contract on behalf of the City of Lakewood for the improvement <br />of Rocky River Harbor. <br /> <br /> WHEREAS, the U. S. Army Engineers have proposed to construct <br />certain improvements in the Rocky River Harbor to increase its <br />navigability, availability and usefulness to members of the public <br />for boating purposes and to reduce damages from flooding, and <br /> <br /> WHEREAS, the Department of Natural Resources of the State of <br />Ohio, the Board of Park Commissioners of the Cleveland Metropoli- <br />tan Park District, the Cities of Lakewood and Rocky River, and <br />various private interests, are all concerned with the improvement <br />and regulation of Rocky River Harbor, and <br /> <br /> WHEREAS, it is proposed that of a total estimated cost of <br />$460,000.00, the United States Government will pay $235,000.00 <br />aris the local interests mentioned above will pay $225~000.00, of <br />whzch the City of Lakewood has been asked to pay $10,000.00, and <br /> <br /> WHEREAS, the improvement of such harbor is desirable and <br />beneficial to the people of the City of Lakewood, and is for a <br />public purpose, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of a munic- <br />ipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and is hereby authorized and <br />directed to enter into agreement with the aforesaid public bodies <br />relative to the improvement of Rocky River Harbor, in substan- <br />tially the following form: <br /> <br /> THIS AGREEMENT entered into by and between the Department <br />of Natural Resources of the State of Ohio (hereinafter referred to <br />as "State of Ohio"); Board of Park Commissioners of the Cleveland <br />Metropolitan Park District (hereinafter "Park Board" or Park <br />District")~ the City of Lakewood, and the City of Rocky River, at <br />Cleveland, Ohio, this day of ~ <br />1965; ' ' <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the United States Government is considering the <br />construction of harbor improvements at Rocky River Harbor, lo- <br />cated within the Cities of Lakewood and Rocky River, Cuyahoga <br />Co~mty~ Ohio, consisting of the construction of the following: <br /> <br />Minor realignment of the inner end of the existing <br />Federal entrance channel, extension thereof 100 feet <br />upstream~ and provision of an anchorage basin~ 2 acres <br />in extent, adjacent to the west side of the ~hannel~ <br />all to a depth of 10 feet; <br /> <br /> <br />
