AS AMENDED - Meeting April 19, 1965 Meeting May 3, 1965 ORDINANCE NO. 33-65 BY: Messrs. Gaydos, Usher, Ward, Wendling. AN E~ERGENCY ORDINANCE authorizing the Mayor to enter into a contract on behalf of the City of Lakewood for the improvement of Rocky River Harbor. WHEREAS, the U. S. Army Engineers have proposed to construct certain improvements in the Rocky River Harbor to increase its navigability, availability and usefulness to members of the public for boating purposes and to reduce damages from flooding, and WHEREAS, the Department of Natural Resources of the State of Ohio, the Board of Park Commissioners of the Cleveland Metropoli- tan Park District, the Cities of Lakewood and Rocky River, and various private interests, are all concerned with the improvement and regulation of Rocky River Harbor, and WHEREAS, it is proposed that of a total estimated cost of $460,000.00, the United States Government will pay $235,000.00 aris the local interests mentioned above will pay $225~000.00, of whzch the City of Lakewood has been asked to pay $10,000.00, and WHEREAS, the improvement of such harbor is desirable and beneficial to the people of the City of Lakewood, and is for a public purpose, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a munic- ipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and is hereby authorized and directed to enter into agreement with the aforesaid public bodies relative to the improvement of Rocky River Harbor, in substan- tially the following form: THIS AGREEMENT entered into by and between the Department of Natural Resources of the State of Ohio (hereinafter referred to as "State of Ohio"); Board of Park Commissioners of the Cleveland Metropolitan Park District (hereinafter "Park Board" or Park District")~ the City of Lakewood, and the City of Rocky River, at Cleveland, Ohio, this day of ~ 1965; ' ' WITNESSETH: WHEREAS, the United States Government is considering the construction of harbor improvements at Rocky River Harbor, lo- cated within the Cities of Lakewood and Rocky River, Cuyahoga Co~mty~ Ohio, consisting of the construction of the following: Minor realignment of the inner end of the existing Federal entrance channel, extension thereof 100 feet upstream~ and provision of an anchorage basin~ 2 acres in extent, adjacent to the west side of the ~hannel~ all to a depth of 10 feet;
