- 2 A channel 100 feet wide and 8 feet deep from the inner end of the entrance channel upstream approximately 1,?00 feet to a point near the railroad bridge; and Thence a channel about 1,850 feet in length and 60 feet wide with depths of 6 feet in soft material and ? feet in hard material with suitable widening at the public dock and at its upstream end adjacent to the public boat launching facilities, and WHEREAS, the estimated cost of such improvements is $460,000. of which it is proposed that the United States Government pay $235,000; and WHEREAS, the Division Engineer, U. S. Army Corps of Engineers, has recommended that such improvements be constructed by the United States Government subject to the condition that responsible local interests give assurances that they will: Contribute in cash 49 percent of the first cost for con- struction of the improvements, such contribution, pres- ently estimated at $225,000. to be paid in a lump sum prior to initiation of construction, subject to final adjustment after actual costs have been determined; b. Hold and save the United States free from damages due to the construction and maintenance of the improvements~ Establish a competent and properly constituted public body empowered to regulate the use, growth and develop- ment of the harbor facilities with the understanding that said facilities will be open to all on equal terms~ d. Provide and maintain suitable depths in service channels to principal docks and berthing areas~ and Continue to maintain without cost to the United States the public dock and launching facilities open to all on equal terms. NOW, THEREFORE, IT IS AGREED by and between the State of Ohio, Department of Natural Resources~ Cleveland Metropolitan Park Dis- trict; and the Cities of Lakewood and Rocky River, in considera- tion of the mutual promises and contributions provided for herein and subject to the approval of such project and appropriation of funds therefor by the Congress of the United States, that: The parties hereto will, prior to initiation of con- struction, contribute to the United States Government the sum of $~25,000. being ~9 percent of the estimated cost of said improvements. The participation of such contribution shall be as follows: State of Ohio $ 1~2,500.00 Park District $ 49~000.00 Lakewood $ 10,000.00 Rocky River $ 10,000.00 To be collected from local private interests by Park Board $ ....!3~500.00 Total $ 225,000.00
