-3- <br /> <br />5ol <br /> <br />24.6% of the total ~onstruction costs including appro- <br />priate engineering and iegal fees of approximately <br />12.5%, but not including the $600,000 Federal Grant <br />received by~LAKEWOOD. CLEVELAND'S share~ shall be paid <br />in twenty-five (25) annual installments beginning <br />July 1, 1965o <br /> <br />After each five (5) year period starting July 1, 1965, <br />the average daily usage by each City of the capacity of <br />the Lakewood ~lantshall~ be determined,.and the arrange- <br />ment for' financial support of constructz0n costs for the <br />following 5 years shall be mod'ified to re~lect the usage <br />by either City of capacity that was allotted to theother <br />City. This modification of financial support of con- <br />struction costs shall be reflected in the CLEVELAND <br />annual payment, and an annual amount arrived at by divid- <br />ing CLEVELAND'S annual payment as ~escribed in Item 5, <br />by 32 shall be the adjustment for each 0ol MoG~Do that <br />CLEVELAND' may have used of LAKEWOOD'S allotted capacity, <br />or that LAKEWOOD might have used of CLEVELAND'S allotted <br />capacity. <br /> <br />CLEVELAN~ shall pay 15% of the gross operation and maint- <br />enance costs ofthe new Lakewood Sewage Treatment Plant, <br />payable quarterly. Such payments shall begin after the <br />plant is put into operation and starts to treat CLEVELAND <br />sewage from the West Park area, and the diversion sewer <br />at West ll7th Street has been completed, and shall con- <br />tinue through July i, 1968. <br /> <br />Although CLEVELAND'S 15% share of operating costs is to <br />be computed on the basis of total operating costs in- <br />cluding sludge treatment, ali revenue that is derived <br />from the sale of sludge shall be entirely for the benefit <br />of LAKEWOODo All costs incurred through the sale of <br />sludge shall be borne by LAKEWOOD, <br /> <br />The engineers have designed the neWLakewood Plant to <br />accoraraodate i3 MoGoDo, of which 9,8 H.G.Do is assigned <br />to LAKEWOOD (or others) and 3.2 M.G.D. is assigned to <br />CLEVEIJtND (West Park Area). CLEVELAND's 15% share of <br />gross operation and maintenance costs is to be paid by <br />CLEVELAND ~til July 1, 1968 regardless of Wastewater <br />volume° Thereafter, if the wastewater flows from either <br />or both communities are in excess of the volumes assigned~ <br />there shall be modification of the proration of operating <br />and maintenance costs to provide for additional payment <br />for flows in excess of the capacity assigned to the <br />community. <br /> <br />This shall be done by assuming a uniform cost for each <br />unit of flow and determining the cost of treating 13 <br />MoGoDo, the design capacity, and the cost of treating the <br />excess flow. The costs of the first 13 MoG.Do shall be <br />assessed in accordance with Paragraph 6o The costs of <br />excess flow shall be assessed against both cities in <br />proportion to their actual share of excess flowo <br /> <br />Capital expenditures involving necessary improvements~ <br />replacements and betterments which are required in order <br />that the new Lakewood Sewage Treatment Plant operates <br />safely and properly and be able to provide a degree of <br />treatment deemed satisfactory to the Health Department <br />of the State of Ohio up to the designed flow of 13 MoGoD. <br /> <br /> <br />
