Bennett, Cain, <br /> Gaydos, Hu£fman, <br /> Usher, Ward. <br /> AN EMERGENCY OBDINANCE authorizing the Mayor- <br />Ex-Offici~ Director of Public Safety, on behalf of the City of <br />Lakewood, ~o enter into an agreement with the ~ity of Fa%rvie~ <br />Park for ~e interchange of the service of their respective f~re <br />department~ and the use of f~re'apparatus, all as hereinafter <br />more speci~ically provided.. <br /> <br /> WHEREAS, Section 717.02 of the Revised Code <br />authorizes m~nicipalities to enter into contracts for mutual fire <br />protection, and, <br /> <br /> WHEREAS, An emergency exists in that in the judg~ <br />ment of this Council hazards are such as to require immediate action <br />to afford full protection of the City of Lakewood and its citizens, <br />and in that this ordinance provides for the immediate preservation <br />of the public peace, property, health or safety, and for the usua~~ <br />daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COD/qCIL OF THE CITY OF <br />LAKEW(M)D, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor - Ex-Officio Director <br />of Public Safety, is hereby authorized and directed on behalf of the <br />City of Lakewood to enter into an agreement with the City cf Fai.rview <br />Park, which said agreement shall read substantially as follows:: <br /> <br />THIS AGREEMENT, made and entered into this , ,, day of <br /> , 196_, pursuant to the authority of Section <br />717.02, Revised Code, by and between the City cf Fairview <br />Park, a municipal corporation, by its Mayor, pursuant to <br />the authority of Section of the Codified Ordinances <br />of the City of Fairview Park, 'and the City of Lakewood, a <br />municipal corporation, hereinafter referred to as the second <br />party, by'its Mayor -Ex-Officio Director of Public Safety, <br />pursuant to the authority of Ordinance No. . , <br />adopted . , 196 ~. <br /> <br />W I T N E S S-E T H: <br /> <br />That the parties hereto agree for and in consideration of <br />the mutual promises each to the other made as follows: <br /> <br />1. The City of Fairview Park agrees to furnish, at the <br />request of the officers designated for such purpose by the <br />second party, such pieces of fire fighting apparatus as <br />may be requested, within the ability of'the City so to do <br />without unduly imperiling the safety of the citizens, and <br />without the establishment of any fire houses or fixed <br />equipment outside the city limits. <br /> <br />2~ The second party agrees to pay promptly, upon receipt of <br />invoice therefor, the sum of ninety-five dollars ($95.00) for <br />the first hour or fraction thereof for each piece of apparatus <br />so furnished, plus the sum of sixty-five dollars ($65.00) for <br />each subsequent hour or fraction thereof. <br /> <br /> <br />
