3. The second~arty further agrees to pay promptly, upon <br />receipt' of inVOice therefor, any sum charged as compensation <br />for l~,ss or d~age to equipment or apparatus while engaged <br />outside the limits of th~City of Fairview Park under this <br />agreement. <br /> <br />4. The second party further agrees fully and promptly to <br />reimburse the ~ity of Fairview Park, or the Firemen's Relief <br />and Pension Fund, as the case may be, for any pension or in- <br />demnity or pre~iumcontribution assessed against the City of <br />Fairview Park ~or Workmen,s Compensation benefits for injuries <br />or death of members of the Division of Fire occurring while <br />engaged in rendering service under this agreement. <br /> <br />5. This agreement shall in no event be held or construed as <br />conferring a right of action for damage on any property owner <br />or any other person, firm or corporation for the operation or <br />failure to operate hereunder. <br /> <br />6. Second party agrees to furnish like apparatus and service <br />to the City of Fairview Park under the same terms and conditions <br />hereinabove applicable to the furnishing of such apparatus and <br />eervice to second party by the City of Fairview~Park. <br /> <br />7. This agreement shall be in force and effect for a period of <br />three years beginning January 1, 1966 and ending December 31, <br />1968, unless terminated during such period by either party, <br />in the manner hereinafter provided. Either party hereto may <br />terminate this agreement at any time during such period, by <br />giving written notice to the other party of such intention to <br />terminate, at least sixty days prior to the date which shall <br />be stated in such notice as the date of termination. <br /> <br />IN WITNESS WHEREOF, the parties hereto have set their hands <br />as of the date first above written. <br /> SIGNATURES' <br /> <br /> Section 2. That the officers authorized to re- <br />quest the City of Fairview Park to furnish the apparatus and ser- <br />vice as provided in said agreement are hereby designated to be: <br />The Mayor, the acting Mayor, the Chief of the Division of Fire, <br />and the Assistant Chiefs of the Division of Fire. <br /> <br /> Section 3. This ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble here- <br />of and provided it receives the affirmative vote of two~thirds of <br />all members elected' to Council, it shall take effect andbe in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: Dece~be~.....~0, 1965 ....
