ORDINANCE NO. 4-67 BY: Gaydos, Huffman, Kelley, Usher, Ward, Wendling AN EMERGENCY ORDINANCE to enact new Sections 967°20 to 967.24, inclusive, of the General Offenses Code of the Codified Ordinances of the City of Lakewood relating to junk vehicles° WHEREAS, An emergency exists in the City of Lakewood in that junk vehicles which are so dismantled, destroyed or otherwise changed so as to lose their character as motor vehicles, are abandoned in public streets, on public property or upon private property, thereby becoming hazardous playgrounds for children, fire traps and rat infested; and the certificates of title not being cancelled and said vehicles disrupting the free flow of traffic on the streets of the City of Lakewood, and, WHEREAS, It is the opinion of this Council that it is a reasonable exercise of the police power of this muni- cipality to provide for a speedy procedure to.move junk vehicles from both public and private places within the City of Lakewood, and, WHEREAS, This ordinance constitutes an emergency measure providing for the immediate preservation of the public peace and safety and for the usual daily operation of a muni- cipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the General Offenses Code of the Codified Ordinances of the City of Lakewood be and the same is hereby supplemented by enacting new Sections 967.20 to 967°24, inclusive, to read as follows: Section 967.20 Definitions The words "motor vehicle" and "junk vehicle" whenever referred to in this ordinance are defined as follows: (A) '~Motor vehicle" means any vehicle propelled or drawn by power other than muscular power or power collected from overhead electric trolley wires, except road rollers, traction engines, power shovels, power cranes and other equipment used in construction work and not designed for or employed in general highway transportation, well drilling machinery, ditch digging machinery, farm machinery, threshing machinery, hay bailing machinery, corn sheller, hammermill and agricultural tractors and machinery used in the pro- duction of horticultural, agricultural, and vegetable products. (B) "Junk vehicle" means a former motor vehicle which is so dismantled, destroyed or changed that it physically is no longer a motor vehicle or is not the motor vehicle described in the purchaser's certificate of title°
