ORDINANCE NO. 4-67 <br /> <br />BY: Gaydos, Huffman, Kelley, <br /> Usher, Ward, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to enact new Sections <br />967°20 to 967.24, inclusive, of the General Offenses Code of <br />the Codified Ordinances of the City of Lakewood relating to <br />junk vehicles° <br /> <br /> WHEREAS, An emergency exists in the City of <br />Lakewood in that junk vehicles which are so dismantled, <br />destroyed or otherwise changed so as to lose their character <br />as motor vehicles, are abandoned in public streets, on public <br />property or upon private property, thereby becoming hazardous <br />playgrounds for children, fire traps and rat infested; and <br />the certificates of title not being cancelled and said vehicles <br />disrupting the free flow of traffic on the streets of the <br />City of Lakewood, and, <br /> <br /> WHEREAS, It is the opinion of this Council that <br />it is a reasonable exercise of the police power of this muni- <br />cipality to provide for a speedy procedure to.move junk vehicles <br />from both public and private places within the City of Lakewood, <br />and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />peace and safety and for the usual daily operation of a muni- <br />cipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood be and the same is <br />hereby supplemented by enacting new Sections 967.20 to 967°24, <br />inclusive, to read as follows: <br /> <br />Section 967.20 Definitions <br /> <br />The words "motor vehicle" and "junk vehicle" whenever <br />referred to in this ordinance are defined as follows: <br /> <br />(A) '~Motor vehicle" means any vehicle propelled or <br />drawn by power other than muscular power or power <br />collected from overhead electric trolley wires, except <br />road rollers, traction engines, power shovels, power <br />cranes and other equipment used in construction work <br />and not designed for or employed in general highway <br />transportation, well drilling machinery, ditch digging <br />machinery, farm machinery, threshing machinery, hay <br />bailing machinery, corn sheller, hammermill and <br />agricultural tractors and machinery used in the pro- <br />duction of horticultural, agricultural, and vegetable <br />products. <br /> <br />(B) "Junk vehicle" means a former motor vehicle which is <br />so dismantled, destroyed or changed that it physically is <br />no longer a motor vehicle or is not the motor vehicle <br />described in the purchaser's certificate of title° <br /> <br /> <br />
