-2- <br /> <br />plans, specifications, estimates and profiles heretofore approved snd now on <br />file in the office of the Director of Public Worksj t~e character of the <br />materials to be bid upon for the paving is asphaltic concrete and for the <br />curbs is stone or concrete as shown on the plans, and reference is made to <br />said plans and specifications for the character of the other materials for <br />such improvement. <br /> <br /> Section S. That the Board of Revision of Assessments has reported <br />to this Council that no claims for damages resulting from the improvement have <br />been filedj but if it should be determined that any claims have been filed, <br />they shall be inquired into before the com~encment of the proposed improvement, <br />and the Director of Law shall be, and he is hereby authorized and directed to <br />institute legal proceedings in a court of competent jurisdiction to inquire <br />into any claims so filed. <br /> <br /> Section 4. That not more than 98~ of the whole cost of said improve- <br />ment shall be assessed by the percentage of the tax valuation upon the following <br />described lots and lands, to wit: <br /> <br /> The property now or formerly owned by Harry Miller and Rose Miller <br />and conveyed to them by deed recorded in Volume 9486 at Page 166 of Cuyehoga <br />County Deed Records and filed for record on March 26, 1959, by John A. Kupchik <br />and Genevieve Kupchik and conveyed to them by deed recorded in Volume 11S45 <br />at Page 679 of Cuyahoga County Deed Records and filed for record on October 2S, <br />1964, by Willy I. Sapell and Phyllis L. Sapell and conveyed to them by deed <br />recorded in Volume lll87 at Page 569 of Cuyahoga County Deed Records and filed <br />for record on September 10, 1964, and by Mary Petrinka and conveyed to her by <br />deed recorded in Volume 867S at Page 7S5 of Cuyahoga County Deed Records and <br />filed for record on August ~l, 1956, which said lots and lands are hereby <br />determined to be specially benefited by said improvement; and the cost of said <br />improvement shall include the cost of preliminary and other surveys, plans, <br />specifications, profiles and estimates and of printing, serving and publish- <br />ing notices, resolutions and ordinances, the amount of damages resulting from <br />the improvement assessed in favor of any owner of land affected by the im- <br />provement and the interest thereon, the costs incurred in connection with the <br />preparation, levy and collection of the special assessments, the cost of pur- <br />chasing, appropriating, snd othez~ise acquiring therefor any required real <br />estate of interests therein, payment of ad valorem taxes, expenses of legal <br />services including obtaining an approving legal opinion, cost of labor and <br />material and interest on bonds and notes issued in anticipation of the levy and <br />collection of the special assessments together with all other necessary ex- <br />penditures. <br /> <br /> Section 5. That the list of estimated assessments as heretofore pre- <br />pared bythe Director of Finance and included in the report of the Board of <br />Revision of Assessments be and the same is hereby approved and the assessments <br />so to be levied shall be paid in fifty (50) semi-annual installments, with <br />interest on deferred payments at the same rate as shall be borne by the bonds <br />to be issued in anticipation of the collection thereof, provided that the <br />owner of any property to be assessed may, st his option, pay such assessment <br />in cash within thirty (30) days after the passage of the assessing ordinance. <br /> <br /> Section 6. That obligations of the City shall be issued, in <br />anticipation of the collection of special assessments by installments and in <br />an amount equal thereto, for the purpose of providing funds to pay the cost <br />of this improvement. <br /> <br /> Section 7. That the remainder of the entire cost of this improvement, <br />after application of the assessments herein provided shall be paid by the <br />issuance of notes and bonds of the City in the msnner provided by law. <br /> <br /> Section 8. That pursuant to Article XIV, Section 16 of the Charter <br />of the City, the Director of Public Works ~ heretofore certified to this <br />Council thst his estimate of the life of the improvement described in Section <br />1 and 2 hereof is twenty-five (25) years. <br /> <br /> <br />
