ORDINANCE NO. 37-67 <br /> <br />BY: <br /> <br /> AN ORDINANCE to amend Section 1117.03 and to enact a new <br />$~nt~on 1117.031 of the Zoning COde of the Codified Ordinances of <br />the City of Lakewood,both relating to non-conforming uses. <br /> <br /> BE IT ORDAINED BY TNE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That Section 1117.03 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br /> Section 1117.03 NON-CONFORMING USES <br /> <br /> '~ non-conforming use existing at the time of the passage of <br /> Ordinance 1786, passed February 13, 1922, may be continued. <br /> A non-conforming use shall not be extended except as authoriz- <br /> ed by Sections 1117.01 and 1117.02, but the extension of a <br /> use to any portion of a building which portion was arranged or <br /> designed for such non-conforming use at the time of the <br /> passage of Ordinance 1786, passed February 13, 1922, shall <br /> not be deemed the extension of a non-conforming use. A <br /> building arranged, designed or devoted to a non-conforming <br /> use at the time of the passage of Ordinance 1786, passed <br /> February 13, 1922, may not be reconstructed or structurally <br /> altered to any extent exceeding in aggregate cost, during any <br /> ten (10) year period sixty per cent (60%) of the assessed <br /> value of the building unless the use of said building is <br /> changed to a conforming use. A non-conforming use may not <br /> be changed unless changed to a higher use. A non-conforming <br /> use if changed to a conforming use may not thereafter be <br /> changed back to any non-canforming use. A non-conforming use <br /> if changed to a higher non-cunforming use may not thereafter <br /> be changed unless to a still higher use. A non-conforming <br /> use included in a 3b or 3c use class shall not be ~hanged <br /> unless changed to a conforming use. In a residence district <br /> a non-conforming use included in a 2b or 3a use class shall <br /> not be changed unless changed to a conforming use. For the <br /> purpose of this code a use shall be deemed to be changed if <br /> changed from a use included in a subdivision of a use class <br /> to a use not included in such subdivision. For the purpose <br /> of this code a non-conforming use shall be deemed to be <br /> changed to a higher use if the use to which such non-conform- <br /> ing use is changed is a use included in a subdivision of a <br /> use class that in the arrangement of classes and subdivisions <br /> in the classification of uses precedes the subdivision in <br /> which such non-conforming use is included." <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />SectionQll7.03 Non-conforming uses <br /> <br />The lawful use of any building or structure and of any land <br />or premises, as existing and lawful at,the time of the enact- <br />ment of this ordinance or any amendment thereto, or the enact- <br />ment of any ordinance which causes a conforming use to become <br />a non-conforming use, may be continued as long as it remains <br />otherwise lawful, subject to the following provisions: <br /> <br />ao A non-conforming use shall not be extended except <br />as provided in Section 1117.031.
