-2- <br /> <br />shall be defined to mean any increase in the floor <br />area; storage capacity, or equipment used in connection <br />with such non-conforming use. <br /> <br />b. A non-conforming use shall not be changed unless <br />changed to a conforming use. <br /> <br />c. A non-conforming use if changed to a conforming use <br />may not thereafter be changed back to a non-conforming <br />use. <br /> <br />d. Whenever a non-conforming use has been abandoned <br />or discontinued for a period of one (1) year, such use <br />shall not thereafter be re-established and any future use <br />shall be in conformity with the uses authorized by <br />ordinance in the use district in which it is located. <br /> <br /> Section 2. That the Zoning Code of the Codified <br />Ordinances of the City of La~ewood, be and the same is hereby <br />supplemented by enacting new Section 1117.031 to read as follows: <br /> <br />Section 1117.031 Structural Alterations and Repairs <br /> <br />A structure or building which is non-conforming or is devoted <br />partly or wholly to a non-conforming use may be maintained <br />and repaired, or altered in internal arrangement, but no <br />reconstruction or structural alterations shall be made except <br />as hereinafter provided. <br /> <br />a. The term "structural alterations" shall be defined <br />so as to include a change or re-arrangement in the <br />structural parts or in the entrance or exit facilities, <br />any enlargement, and any change in the supporting members <br />suchas bearing wall, columns, beams or girders. <br /> <br />b. In accordance with Article XVI, Section 2, Paragraph <br />4, of the City Charter, The Board of Zoning Appeals is <br />hereby authorized to permit such reconstruction, or <br />structural alterations to an extent not to exceed, in <br />aggregate cost, during any ten (10) year period, one <br />hundred (100) per cent of the assessed value of the <br />building. Such permission may be granted by The Board <br />of Zoning Appeals in the exercise of its discretion, <br />only if it finds all of the following: <br /> <br />That there exists practical difficulty or unnecessary <br />hardship, fully described in the findings of the <br />Board, that would deprive the owner of the reason- <br />able use of the land or building involved. <br /> <br />That the non-conforming use is one which cannot <br />reasonably be expected to become conforming in the <br />forseeable future. <br /> <br />That there are special circumstances or conditions, <br />fully described, in the findings of the Board apply- <br />ing to such land or buildings, and not applying <br />generally to land or buildings in the neighborhood, <br />and that said circumstances or conditions are such <br />that strict application of the provisions of the <br />ordinances of the City of Lakewood would deprive the <br />applicant of the reasonable use of such land or <br />buildings. <br /> <br /> <br />
