ORDINANCE NO. 77-6~ <br /> <br />BY: Gaydos, Graber, Kelley, <br /> ward, usher, Wendling <br /> <br /> AN EMERGENCY ORDINANCE providing for the sale of <br />certain real property located at the northeast corner of <br />Franklin Boulevard and Wyandotte Avenue in the City of <br />Lakewood, Ohio. <br /> <br /> WHEREAS, The said real property (hereinafter described <br />in the body of the agreement) owned by the City of Lakewood, <br />is no longer needed for any municipal purpose, and, <br /> <br /> WHEREAS, For the foregoing reason, it is in the best <br />interest of the City of Lakewood that said real property be <br />sold~ and, <br /> <br /> WHEREAS~ The Board of Control of the City of Lakewood <br />has directed that said real property be sold, and, <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1o It is hereby determined that the real <br />property described in the agreement set forth herein is no <br />longer needed for municipal purposes. <br /> <br /> Section 2. This Council hereby authorizes the sale of <br />said land to James A. Higgins and Ruth E. Higgins, husband and <br />wife, and the Mayor is authorized and directed to execute, on <br />behalf of the City of Lakewood, a contract for the sale of <br />said property~ in substantially the following form: <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT made and concluded at Lakewood, Ohio, this <br />__day of ., 1968, by and between the City of <br />Lakewood, whose mailing address is 12650 Detroit Avenue, <br />Lakewood, Ohio, hereinafter called the "VENDOR" and <br />James A. Higgins and Ruth E. Higgins, husband and wife, whose <br />mailing address is 1543 Wyandotte Avenue, Lakewood, Ohio, <br />hereinafter called the "VENDEES", <br /> <br />WITNESSETH: <br /> <br />That in consideration of the mutual promises of the parties <br />herein contained, the VENDOR agrees to sell and convey and <br />the VENDEES agree to purchase and pay for, upon and under <br />the provisions, terms and conditions herein expressed, the <br />following described premises situated in the City of Lakewood, <br />County of Cuyahoga and State of Ohio, and known as being <br />part of Original Rockport Township Section Number 21, being <br />a part of Sublot Number 92 in the Stein-Subdivision as shown <br />by the recorded plat in Volume 30 of Maps, Page 16 of Cuyahoga <br />County Records, and bounded and described as follows: <br /> <br /> <br />
