they are unable t~ agree upon an impartial chairman, <br />they shall jointly or separately request a panel of five <br />(5) names from the American Arbitration Association. The <br />representatives of the City and the employee organization <br />involved will alternately strike names from the list until <br />one (1) name remains. The remaining name shall be the <br />chairman of the fact-finding authority. Council shall by <br />ordinance provide for such compensation and reimbursement <br />for expenses as may be appropriate in the circumstances <br />for members of the fact-finding authority. <br /> <br />(d) The chairman shall convene the fact-finding authority <br />as soon after his appointment as possible. Thereafter, <br />the representative of the City and the employee organiza- <br />tion involved shall submit their respective positions to the <br />fact-finding authority for its review and recommendations. <br />The fact-finding authority shall, within fifteen (15) days <br />if possible, issue in writing a fact-finding report. This <br />report shall be served upon the respective chairmen of the <br />negotiating committee for the City and the employee <br />organization involved, and the Mayor and the President of <br />Council. As soon after receipt of such report is possible, <br />the representatives of the City and employee organization <br />shall meet again and seek to reach agreement. If subse- <br />quent agreement is reached, it will be submitted to Council <br />for appropriate action. If agreement is not reached within <br />fifteen (15) days of the issuance of the report (unless <br />the parties mutually agree to extend the fifteen (15) day <br />period), the fact-finding report.will be submitted by the <br />President of Council, together with the respective pOsitions <br />of the City and employee organization involved, to Council <br />for its decision. <br /> <br />S. ection 157.05 No Strike. <br /> <br />Nothing in this OrdinanCe shall constitute a grant of the <br />right to strike to employees of the City and such strikes <br />are prohibited. <br /> <br />Section 157.06 ReServation of Rights. <br /> <br />City officials and department supervisors retain the right <br />in accordance with applicable laws and regulations: <br /> <br />(a) to direct the work of City employees; <br /> (b) to hire, promote, transfer, assign and return City <br /> employees and to suspend, demote, discharge or take <br /> other disciplinary action against such employees; <br /> (c) to relieve employees from duties because of lack of <br /> work or for other legitimate reasons; <br /> (d) to maintain the efficiency of the government operations <br /> entrusted to them; <br /> (e) to determine the methods, means and personnel by which <br /> such operations are to be conducted; and <br /> (f) to take whatever actions may be necessary to carry out <br /> the purposes of the department in situations of <br /> emergency. <br /> <br />Section 157.07 Severability. <br />In the event any part or portion of this Chapter shall be <br />found to be contrary to law and thereby held to be null and <br />void, all other provisions of this Chapter shall remain in <br />full force and effect, and shall not be otherwise affected <br />by any such ruling, finding, or decision. <br /> <br /> <br />
