Gaydos, Graber, <br />Huffman, Kelley, Usher, <br />Ward, Wendling <br /> <br /> AN EMERGENCY ORDIN~MCE to amend sub-paragraphs "b", <br />"c" and "d"of Section 157.04 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood relating to Collective <br />Bargaining Procedure. <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety and welfare and for the usual daily operation of <br />municipal departments; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That sub-paragraphs "b", "c" and "d" of <br />Section 157.04 of the Administrative Code, now reading as follows: <br /> <br />Section 157.04 Collective Bargaining Procedure <br /> <br />"(b) Whenever a "List of Requests" has been submitted to <br /> the Finance Committee as outlined in paragraph (a) abOve, <br /> the Committee through its Chairman or designated repre- <br /> sentative shall respond to such requests by January 15th <br /> of each year. <br /> <br />(c) · In .the event the representatives of the City and the <br />employee organization involved are unable to reach an agree- <br />ment by February 15th, one or both may advise the Mayor and <br />.the President of City Council in writing of the failure to <br />reach an agreement and request fact-finding. The President <br />of City Council shall forthwith designate one person as <br />the City's member of a fact-finding authority and shall advise <br />the employee organization of the name of such member. The <br />employee organization shall forthwith designate one person <br />as the employee member of the fact-finding authority, and <br />shall advise the Mayor and the President of City Council in <br />writing of the name of such member. The two designated <br />members shall attempt to agree upon an impartial third person <br />as chairman of the fact-finding authority. They shall jointly <br />serve in writing upon the Mayor and President of City Council <br />the name of the chairman so selected. In the event ~they are <br />unable to agree upon an impartial chairman, they shall jointly <br />or separately request a panel of five (5) names from the <br />American Arbitration Association. The representatives of <br />the City and the employee organization involved will alter- <br />nately strike names from the list until one (1) name remains. <br />The remaining name shall be the chairman of the fact-finding <br />authority. Council shall by ordinance provide for such com- <br />pensation and reimbursement for expenses as may be appropriate <br />in the circumstances for members of the fact-finding authority. <br /> <br />(d) The chairman shall convene the fact-finding authority <br />as soon after his appointment as possible. Thereafter, the <br />representative of the City and the employee organization <br />involved shall submit their respective positions to the <br />fact-finding authority for its review and recommendations. <br />The fact-finding authority shall, within fifteen (15) days, <br />if possible, issue in writing a fact-finding report. This <br />report shall be served upon the respective chairmen of the <br />negotiating committee for the City and the employee organi- <br />zation involved, and the Mayor and the President of Council. <br /> <br /> <br />
