-2- <br /> <br />As soon after receipt of such report is possible, the <br />representatives of the City and employee organization <br />shall meet again and seek to reach agreement. If subse- <br />quent agreement is reached, it will be submitted to Council <br />for appropriate action. If agreement is not reached within <br />fifteen (15) days of the issuance of the report (unless <br />the parties mutually agree to extend the fifteen (15) day <br />period), the fact-finding report will be submitted by the <br />President of Council, together with the respective positions <br />of the City and employee organization involved, to Council <br />for its decision." <br /> <br />be and the same is hereby amended to read: <br /> <br />Section 157.04 Collective Bargaining Procedure <br /> <br />(b) Whenever a "List of Requests" has been submitted to.the <br />Finance Committee as outlined in paragraph (a) above, the <br />Committee through its Chairman or designated representative <br />shall respond to such requests by January 15th of each year. <br />The Chairman shall then schedule the first bargaining session <br />within ten (10) days thereafter. ~ <br /> <br /> (c) In the event the representatives of the City and the <br /> employee organization involved are unable to reach an agree- <br /> ment by February 15th, one or both may advise the Mayor and <br /> the President of City Council in writing of the failure to <br /> reach an agreement and request fact-finding. The President <br /> of City Council shall forthwith designate one person as the <br /> City's member of a fact-finding authority and shall advise the <br /> employee organization of the name of such member. The employee <br /> organization shall forthwith designate one person as the <br /> employee member of the fact-finding authority, and shall advise <br /> the mayor and the President of City Council in writing of <br /> the name of such member. No person shall be eligible to serve <br /> on the fact-finding authority if he is or has been an employee <br /> of the City or the employee organization, or if he has <br /> participated in negotiations on the issues under consideration <br /> or has been involved in any way directly or indirectly in <br />'preparation of such issues. The two designated members shall <br /> meet within five (5) days of their designation and shall <br /> attempt to agree upon an impartial third person as chairman of <br /> the fact-finding authority. They shall jointly serve in <br /> writing"upon the Mayor and the President of City Council the <br /> name of the chairman so selected. In the event they are <br /> unable to agree upon an impartial chairman, they shall jointly <br /> or separately request a panel of five (5) names from the <br /> American Arbitration Association, who, upon inquiry, have <br /> indicated availability to meet as a member of the fact-finding <br /> authority within ten (10) days of selection. The representa- <br /> tives of the City and employee organization involved will <br /> alternately strike names from the list until one (1) name <br /> remains. The individual whose name remains shall be selected <br /> as the chairman of the fact-finding authority unless for any <br /> reason he gives subsequent notice that he will be unable 'to <br /> meet within ten (10) days. tn that event, the fourth name <br /> stricken shall be chosen. Fees charged by members of the <br /> fact-finding authority and any other costs involved shall be <br /> divided equally between the City and the employee organization. <br /> <br />(d) The chairman shall convene.the fact-finding authority <br /> <br /> <br />
