-2- <br /> <br />Sectto. 197.O.3 Rlgl~Ln o£ City I~mployee:J <br /> <br />City eml, loy~'cs shall have the rb;ht of. sel£-orga, izacion, to form <br />and join associations for representation purposes, to join, £orm <br />and a££illatc with employee organizations of their o~ ctwosing, <br />and shall have the right to be represented by such representatives <br />or employee organizations of their o~m choice in con£crences, <br />meetings, and' negotiations' with officers, agents, representatives <br />and employees of ~he city on matters affecting their employment. <br /> <br />Section 157~04 Collccti~e Bargaining P~°cedure <br /> <br />(a) By December 15th of each year, City employees in an appro- <br />priate unit directly, or through an employee organization, where <br />such organization exists, or duly authorized representatives shall <br />submit a "List of Requests" relating to changes sought for the <br />following year in wages and conditions of employment to the Chairman <br />of the Finance Cormnittee of the Council. <br /> <br />(b) Whenever a "List of Requests" has 'been submitted to the Finance <br />Co~aittee as outlined in paragraph (a) above~ the Committee through <br />its Chairman or designated representative shall respond to such <br />requests by January 15th of each year. The Chairman shall then <br />schedule the first bar~ainin~ session within ten ,{10~ days there- <br />after. <br /> <br />(¢) In the event the representatives of the City and the employee <br />organization involved are unable to reach an agreement by February 15 <br />oneor both may advise the Mayor and the President of City Council in <br />writing of the failure to reach an.agreement and request fact-find- <br />~g. The President of City Council shall forthwith designate one <br />person as the City's member of a fact finding authority and shall <br />advise the employee organization of the .name of such member. The <br />employee organization shall forthwith designate one person as the <br />employee member of the fact-finding authority, and shall advise the <br />Mayor and the President of City Council in writing of the name .of <br />such member. No person shall be eti~ible to serve on the fact- <br />~tndin8 authority if he is or has been an employee of the City or <br />the employee organization? or if he has-participated in negotiations <br />on the issues under consideration or has been involved in any way <br /> <br />~irectly or indirectly in preparation of such issues. The two <br />designated members shall meet within five (5) days of ther designa- <br />tion and shall attempt to agree upon an impartial third person as <br />chairman-of the fact-finding authority%. They shall jointly serve <br />imwriting upon the Mayor and the President of City Council the <br />mame of the chairman so selected.- In the event they are unable to <br />agree upon an impartial chariman, they shall jointly or separately <br />request a panel of five (5) names from the American Arbitration <br />Association~ who~ upon inquiry~ have indicated availability to' <br />meet as a member of the fact-findin~ authority within ten (10) <br />days of selection. The representatives of the City and employee <br />organization involved will alternately strike names from the list <br />~til one (1) name remains. The individual whose name remains <br />shall be selected as the chairman of the fact-findinz authority <br /> <br />,unless for any reason he ~ivessubsequent notice that he will be <br />unable to meet within ten (.fO,) days. In that cvcnt~ the fourth <br />name stricken shall be chosen. Fees chart'.ed bv members of the <br />fact-findinq authority and any other costs involved shall be <br />divided equally between the City and the employee ori,.anization. <br /> <br /> <br />
