ORDINANCE NO. 72-70 <br /> <br />BY: Messrs. Usher, Ward, Wendling, <br /> Gaydos, Graber, Huffman, Kelley <br /> <br /> AN EMERGENCY ORDINANCE to supplement Section 351.01 <br />of the Traffic Code of the Codified Ordinances of the City of <br />Lakewood, Ohio by enacting a new sub-paragraph (q) to said sec- <br />tion to prohibit parking in private driveways, alleyways, and <br />areaways between buildings when such parking constitutes a fire <br />hazard or an obstruction to or interference with the operation of <br />fire fighting equipment, and to supplement Section 303.08 of the <br />Traffic Code of the Codified Ordinances of the City of Lakewood <br />by enacting a new sub-paragraph (i) to said section to provide <br />for the removal and impounding of vehicles parked in violation of <br />Section 351.01 (q) of the Codified Ordinances of the City of <br />Lakewood. <br /> <br /> WHEREAS, 'the parking of motor vehicles in private <br />driveways, alleyways, or areaways between buildings may constitute <br />a fire hazard or an obstruction to or interference with the opera- <br />tion of the fire fighting equipment of the City, and <br /> <br /> WHEREAS, it would be in the best interest of the City <br />· to prohibit such parking and to provide for the removal and im- <br /> pounding of such parked vehicles, and <br /> <br /> WHEREAS, pursuant to its police powers this Council <br />has the power to provide for the health, safety, and welfare of <br />its citizens, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing .for the immediate preservation of the public health, <br />safety, and welfare and for the usual daily operation of a municipal <br />department, now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That SeCtion 351.01 of the Traffic Code <br />of the Codified Ordinances of the City of Lakewood be. and the <br />same is hereby supplemented by enacting a new paragraph (q) <br />to said section, said sub-paragraph to read as follows: <br /> <br />351.01 LIMITATIONS ON PARKING. <br />No person shall stand or park a vehicle except when <br />necessary to avoid conflict with other traffic or with <br />the provisions of this Traffic Code~ or in compliance <br />with the directions of a police officer or a traffic <br />control device, in any of the following places: <br /> <br />(q) <br /> <br />In any private driveway, alleyway, or areaway <br />between buildings when in the opinion of the <br />Chief of the Division of Fire and the Chief of <br />the Division of Police, such parking constitutes <br />a fire hazard or an obstruction to or interference <br />with operation of the fire fighting equipment of <br />the City, provided signs are erected giving notice <br />thereof. <br /> <br /> Section 2. That Section 303.08 of the Traffic Code of <br />the Codified Ordinances of the City of Lakewood be and the same is <br />hereby supplemented by enacting a new sub-paragraph (i) to said <br />section, said sub-paragraph (i) to read as follows: <br /> <br /> <br />
