ORDINANCE NO. 25-71 BY: Messrs. Gaydos, Graber, Huffman, Kelley, Usher, Ward, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor on behalf of the City of Lakewood to enter into an Agreement between the Northeast Ohio Areawide Coordinating Agency (NOACA) and the City of Lake- wood, authorizing participation by the City of Lakewood in the NOACA pro- gram for the seven county region. WHEREAS, on June 3, 1968 this Council adopted Resolution No. 4635 which expressed"the willingness of the City of Lakewood to cooperate with the Northeast Ohio Areawide Coordinating Agency", and WHEREAS, on April 5, 1971 Resolution No. 4819 was adopted author- izing the Director of Finance to pay the cost of membership of the City in the Northeast Ohio Areawide Coordinating Agency for the year 1971, and WHEREAS, the Northeast Ohio Areawide Coordinating Agency through its executive director is desirous of formalizing its relationship with participating municipalities, and WHEREAS, this ordinance constitutes an emergency measure for the reason that comprehensive planning and project review for the seven county area is a necessary attribute of proper municipal function and it provides for the immediate preservation of 'the public peace, property~ health and safety and for the usual daily operation of municipal depart- ~ ments, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed on behalf of the City of Lakewood to enter into an agreement with the Northeast Ohio Areawide Coordinating Agency (NOACA) authorizing participation by the City of Lakewood in the NOACA program for the seven county region in substantially the following form. AGREEMENT This agreement entered into on the day of , 1971, by and between the Northeast Ohio Areawide Coordinating Agency, hereinafter referred to as NOACA, and the City of Lakewood, hereinafter referred to as the MUNICIPAL- ITY, WITNESSETH: WHEREAS, for the purpose of responding to the needs engendered by Title II of the Demonstration Cities and Metropolitan Development Act of 1966, Section 701 of the Housing Act of 1954, as amended, the Intergovernmental Cooperation Act of 1968, and other pertinent feder- al and state statutes and programs, an are~wide coordinating agency has been established for the Northeast Ohio Area, including the Metro- politan areas of Cleveland, Akron, and Lorain-Elyria, and the Counties of Cuyahoga, Geauga, Lake, Lorain, Medina, Portage and Summit; and WHEREAS, the provisions of Section 134 of Title 23 - U.S. Code - Highways, require that a continuing compre}%ensive transportation plan- ning process be carried on cooperatively by the states and ]ocal com- munities, w]th~in urban areas of over 50,000 population as a condition for the Federal HLghway AdminJstrat~on's api.~roval of federal aid high- way improvements w.[tl~Jn t]~e urban area involved; and
