ORDINANCE NO. 50-71 <br /> <br />BY: Messrs. Huffmmn, Kelley, Usher, <br /> Ward, Wendling, Gaydos, Graber <br /> <br /> AN EMERGENCY ORDINANCE giving consent of the City of Lakewood, Cuyahoga <br />County, Ohio, to the improvement of Warren Road from Franklin Boulevard to Lake- <br />wood Heights Boulevard under the supervision of the County of Cuyahoga and pro- <br />posing to cooperate with the County of Cuyahoga in certain matters incident <br />thereto. <br /> <br /> WHEREAS, the public convenience and welfare require the improvement of a <br />portion of Warren Road, Lakewood, Ohio, and the County of Cuyahoga is considering <br />the improvement of the public highway which is described as follows: Resurface <br />Warren Road from Franklin Boulevard to Lakewood Heights Boulevard with asphaltic <br />concrete and adjusting castings to grade of the resurfaced pavement where neces- <br />sary, and <br /> <br /> WHEREAS, an emergency exists by reason of the present condition of said <br />road and by reason of the inadequacy of such road to handle existing and antici- <br />pated vehicle traffic between the points hereinbefore designated; in consequence <br />whereof great public imconvenience is being suffered and will be suffered and <br />public vehicular traffic endangered and delayed, and -- <br /> <br /> WHEREAS, it is necessary to proceed at Once in order to complete the <br />improvement of the aforesaid portion of Warren Road during the coming year, and <br /> <br /> WHEREAS, the Council of the City of Lakew~od desires to cooperate with <br />the CountY of Cuyahoga in the improvement of that portion of Warren Road between <br />Franklin Boulevard and Lakewood Heights Boulevard, and .... " <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public peace~ health and safety, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is hereby declared to be in the public interest that the <br />consent of the City of Lakewood be and such consent is hereby given to the County <br />of Cuyahoga to construct the above described improvement in accordance with plans, <br />specifications and estimates as approved by the County of Cuyahogao <br /> <br /> Section 2. The City of Lakewood hereby proposes to cooperate with the <br />County of Cuyahoga in the cost of the above described improvement as follows: <br /> <br /> (a) WHEREAS, the Board of County Commissioners, as administrator o£' <br /> the County Motor Vehicle Five ($5.00) Dollar License Tax Fund, <br /> may upon approval of an application of the City of Lakewood <br /> requesting such funds, authorize an allocation of the aforesaid <br /> funds to the extent of the City of Lakewood's agreed participation <br /> with the County for the road improvement project; and <br /> <br />(b) There shall be no participation by said City of Lakewood for the <br /> aforesaid improvement other than $5.00 License Tax Fund~ <br /> <br /> Section 3. The Mayor is hereby authorized and directed on behalf of <br />the City of Lakewood: to enter into maintenan¢~ and parking agreements and special <br />contractual obligations as are necessary to carry forward the intent and purpose <br />of this ordinance. <br /> <br /> <br />
