ORDINANCE NO. 15-72 <br /> <br />BY: Messrs. Graber, Kelley, Magnotto, <br /> McBride, Usher, Wendling, Brockman <br /> <br /> AN EMERGENCY ORDINANCE to provide for the submission to the electorate <br />of an amendment to The Amended Charter of the City of Lakewood by amending Article <br />XXI Section 7 thereof, pertaining to manner of amending said Charter. <br /> <br /> WHEREAS, an emergency exists in that this Charter amendment is to be <br />presented to the electorate of the City of Lakewood at a primary election to be held <br />on May 2, 1972, and, <br /> <br /> W~{EREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare, now, therefore, <br /> <br /> BE IT O~DAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, <br />TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1. That the question of the amendment of Article XXI Section 7 <br />of The Amended Charter of the City of Lakewood, so that as amended the sameshall be <br />and read as follows: <br /> <br /> Amendments to this Charter m~y be submitted to the electors of the City <br /> by a two-thirds vote of the Council, and, upon petitions signed by ten <br /> per centum of the electors of the City setting forth any such proposed <br /> amendment, shall be submitted by such Council. The submission of a <br /> proposed amendment to the electors shall be governed by the requirements <br /> of Article XVIII, Sections 8 and 9 of the Constitution of the State of <br /> Ohio as to the submission of the question of choosing a charter commission; <br /> amd notice of the proposed amendment may be mailed to the electors as <br /> provided by the Constitution or, pursuant to ordinances adopted by the <br /> Council, notice of the proposed amendments may be given by newspaper ad- <br /> vertising. If any such amendment is approved by a majority of the electors <br /> voting thereon, it shall become a part of the Charter of the Municipality, <br /> except that if two or more inconsistent amendments on the same subject are <br /> submitted at the same election, only the one of such amendments receiving <br /> the largest affirmative yore, not less than a majority of the electors <br /> voting thereon, shall become a part of this Charter. A copy of said <br /> Charter or any amendment thereto shall be certified to the Secretary of <br /> State within thirty (30). days after the adoption by a vote of the electors. <br /> <br /> (Upon adoption of this amendment, present Section 7 of Article XXI of the <br /> Amended Charter of the City of Lakewood shall be repealed) <br /> <br />be submitted to a vote of the qualified electors of the City at the primary election <br />to be held on Tuesday, the 2nd day of May 1972 at the regular places of voting in the <br />City between the hours of 6:30 A.M. and 6:30 P.M. <br /> <br /> Section 2, That the ballots for said election shall, at the top thereof, <br />be entitled, "City Charter Amendment Ballot" and the question to be submitted on <br />said ballot shall be in words following: <br /> <br /> "Shall the proposed amendment of Article XXI Section 7 of the Amended <br /> Charter of the City of Lakewood: <br /> <br />Amendments to this Charter may be submitted to the electors of the City <br />by a two-thirds vote of the Council, and, upon petitions signed by ten <br />per centum of the electors of the City setting forth any such proposed <br />amendment, shall be submitted by such Council.
