ORDINANCE NO. 35-72 <br /> <br />BY: Messrs. Usher, Wendling, Brockman, Graber, <br /> Kelley, Magnotto, McBride <br /> <br />AN EMERGENCY ORDINANCE to enact new Chapter 719 of the Business Regulation Code <br />of the Codified Ordinances of the City of Lakewood entitled "Coin Operated Amuse- <br />ment Devices", to provide for the issuing of pez~its for 'coin operated amusement <br />devices. -- <br /> <br />WHEREAS, there has recently been an increase in the number of coin operated amuse- <br />ment devices displayed in the City of Lakewood, and <br /> <br />WHEREAS, it is deemed for the best interests of the City of Lakewood to require a <br />permit for the display of such coin operated armlsement devices after approval by <br />the Chief of Police and the Building Official under the auspices of the Department <br />of Public Safety, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure for the immediate preser- <br />va=ipn of the public health or safety~ now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Business Regulation Code of the Codified Ordinances of the <br />City of Lakewood be and the same is supplemented by enacting new"Chap~19 to <br />read as follows: <br /> <br />Chapter 719 <br /> <br />Coin Operated Amusement Devices <br /> <br />719.01 DEFINITIONS -~.~. <br /> <br />For the purpose of and as used in this Chapter: <br /> <br /> A. "Amusement device" means any machine or mechanical device which, upon the <br />insertion or deposit of a coin, slug, token, pla e or disc, permits a person or <br />operator of such device display a game or try the skill of such person or opera- <br />tor using such device, whether or not registering a score, or any machine or mechanical <br />device which may cause a person or operator of the same to secure some amusement, en- <br />Joyment, entertainment or relaxation by the use of such machine or device. <br /> <br />B. "Person" shall include the follOWing: <br /> <br /> Any person, firm or corporation which owns an amusement device, or in whose place <br />of business any such amusement device is placed for.use by the public or any person, <br />firm or corporation having control over any such amusement device. <br /> <br />719.02 GAMBLIN~ DEVICES PROHIBITED <br /> <br /> Nothing in this Chapter shall in any way be construed to authorize license or <br />permit any gambling device whatsoever, or any mechanism that has been judicially <br />determined to be a gambling device or in any way contrary ~o any present or future <br />law. <br /> <br />719.03 PERMIT REQUIRED <br /> <br /> Any person displaying for public patronage who installs, operates, or maintains <br />an amusement device as defined in Section 719.01[ must first secure a permit before <br />such amusement device shall be installed for operation or use by the general public. <br /> <br />719.04 PERMIT APPLICATION <br /> <br /> Applications for such permit shall be made to the Department of Public Safety <br /> and shall be on forms prescribed and furnished by the City. Such application shall <br /> include the name, address, age, date and place of birth of applicant, the place <br /> where such amusement device is to be installed, displayed, operated or maintained <br /> and the nature of the business conducted at thal~ place, the total number of such <br /> amusement devices to be displayed, installed, operated or maintained, the description <br />...... of each including the serial numbers of each such device and such other and further <br /> information as may be required by the City. <br /> <br /> <br />
