<br /> Historical soCiety will not be in position to fund the full amount of its shat
<br /> of costs at the time the project is completed, and
<br /> WHE~AS, the expansion of the Old Stone House as a co,unity instit~
<br /> .tion is in the best interest of the City and the time for reimbursement of fu~
<br /> advanced by the City should be extended in order that the project may proceed
<br /> without further delay, and
<br /> WHER~S, this Ordinance constitutes an emergency measure providing
<br /> the usual daily operation of a municipal department; now, therefore,
<br /> BE IT ORDAINED BY THE CO~CIL OF THE CITY OF ~~D, STATE 0F OH]
<br /> Section 1. That the Mayor be and he is hereby authorized and dire~
<br /> to enter into an .~endment to the Agreement wi~ the Lakewood Historical SocJ
<br /> dated April 1, 1974 to extend the time of reimbUrSement by the Lakewood Hist~
<br /> Society of funds advanced by the City, said Agrement to read substantially
<br /> follows:
<br /> A~ND~NT TO AGREE~NT
<br />
<br /> THIS AGREE~NT, made and concluded atakewood, Ohio this
<br /> day of September, 1974 by and betweenhe CITY OF ~WOOD, a
<br /> municipal corporation, by its Mayor, [y authorized by Ordinance
<br /> No. adopted September 3, 1974, ~inafter referred to as
<br /> "CITY" and the ~W~D HISTORI~L S~TY, a non-profit corporatic
<br /> organized under the laws of the Stat~ Ohio, hereinafter referred
<br /> to as "SOCIETY".

<br /> WITNESSETH:
<br /> WHEREAS, the parties hereto did, on Rst day of April, 1974,
<br /> enter into an Agreement providing rom use, maintenance,
<br /> renovation, management and operation~he Old Stone House
<br /> located in Lakewood Park, as a publi~eum, and
<br /> W~REAS, said Agreement provides in iraph 11 that the same may
<br /> be amended at any time upon approval he CI~ and the SOCIETY, a~
<br /> WHEREAS, by reason of circumstances ~ the control of either
<br /> party, it is necessary to amend said~ment as hereinafter set
<br /> forth;
