<br /> AN ORDINANCE to supplement Part Nine -- Streets and Public Services
<br />Code of the Codified Ordinances of the City of Lakewood by enacting new Chapter
<br />902 to establish a sewer service or rental charge.
<br />
<br /> WHEREAS, this Council determines that the establishment of sewer service
<br />or rental charges is essential to provide sufficient funds for the operation,
<br />maintenance, repair~and improvement of the storm and sanitary sewer systems of
<br />the City and any additional funds required for the operation, maintenance, repair
<br />and improvement to the Waste Water Treatment Plant; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> S~ction 1. That Part Nine -- Streets and Public Servi~ces Code of the
<br />Codified Ordinances of the City of Lakewood shall~be and the same is hereby
<br />supplemented by enacting new Chapter 902 to read as follows:

<br />CHAPTER 902
<br />
<br /> SEWER SERVICE CHARGES
<br />
<br />902.01 INTENT AND PURPOSE
<br />
<br />It is hereby determined and declared to be necessary for the due protection of
<br />the public health, safety and welfare of the City of Lakewood and of its residents
<br />to establish and collect, in addition to any taxes levied, or other sources of
<br />funds available for similar purposss, the charges herein provided for the services
<br />of the sewer system, including the Waste Water Treatment Plant, upon all lots,
<br />lands and premises having a connection with the systems. It is hereby further
<br />found and determined that the terms and provisions of this Chapter, including
<br />but not limited to the amounts of such charges and the billing and collection
<br />procedures provided herein, are just and equitable.
<br />
<br />902.02 DEFINITIONS
<br />
<br />As used in this Chapter, certain terms and words are defined as follows:

<br />"Sewage" shall mean water or water-borne wastes,
<br />
<br />"Industrial Wastes" shall mean the liquid wastes resulting from
<br />any commercial, manufacturing or industrial operation or process,
<br />which water-borne or liquid wastes enter the system of sewage, or
<br />any portion thereof, of the City of Lakewood from any premises
<br />having a connection therewith or thereto.

<br />902.03 WASTE WATER TREATMENT FUND
<br />
<br />Monies received from the collection of the sewer service or rental charge
<br />authorized by this Chapter shall be deposited as received with the Director of
<br />Finance, who shall keep a separate and distinct fund and account to be known
<br />as the "Waste Water Treatment Fund". When appropriated by Council, such funds
<br />shall be available for the payment of the cost and expense of the management,
<br />maintenance, operation, testing, cleaning, enlarging, construction, reconstruc-
<br />tion, replacement and repair of such sewer system and/or the Waste Water
<br />Treatment Plant and/or other sewage treatment facilities, and any surplus
<br />in said fund over and above the requirements hereinbefore mentioned may be
<br />used for extensions, improvements and replacements to the system and parts
<br />thereof, or for any other purpose for which such charges are authorized to be
<br />used by the laws of the State of Ohio or Ordinances of the City of Lakewood.

<br />902.04 SEWER SERVICE CItARGE
<br />
<br />For the purposes provided in Section 902.03 hereof, there is hereby levied and
<br />charged upon each lot, parcel of land or premises having a connection with the
<br />sewer system, or otherwise discharging sewage, industrial waste, water or other
<br />
