PLEASE SUBSTITUTE FOR ORDINANCE 13-77 PLACED ON FIRST READING MAY 16, 1977 AND ON SECOND READING JUNE 6, 1977. ORDINANCE NO. 13-77 BY: , Messrs. Brockman, Magnotto, McBride, Salmon, Sinagra, Usher AN EMERGENCY ORDINANCE to amend paragraphs (a) and (b) of Section 769.08 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood relating to taxicab far~, rates in the City of Lakewood. WHEREAS, the taxicab companies serving the Lakewood, Ohio area have advised the City that by reason of increased costs and other factors it has been determined by the companies that taxicab fare rates must be raised in the City of Lakewood, and WHEREAS, this Council has been advised that such request for rate increases has also been made in the City of Cleveland and other areas of the COunty, and WHEREAS, this Council deems it to be in the best interest of the City and its residents that taxicab fare rates be reasonably comparable throughout the entire area served by taxicab companies, and WHEREAS, this Ordinance provic'es for the usual daily operation of a municipal department and for the immediate preservation of the public safety and welfare; now, t'herefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That paragraphs (a) and (b) Of Section 769.08 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood now reading as fdllows: 769.08 RATES OF FARE ~ (a) Metered Rates (a) For the 1st one-sJ, xth mile or fraction thereof $0.80. (b) For each succeeding one-third mile or fraction thereof $0.20. (c) For each additional passenger for the entire trip $0.25. (d) For each taxicab employed upon an hourly rate $6.00 per hour. (e) In addition to the above rates, five cents ($0.05) may be added for the first one-sixth mile or fraction thereof, for each five cents ($0.05) increase in the!cost of gasoline for taxicabs, above forty cents ($0.40) per gallon. For waiting time, as hereinafter defined, charges may be made at the rate of not less than $4.20 per hour nor more %hah $6.03 per hour. Waiting time is deemed to include the time when the taxicab it not in motion, beginning at the place of arrival to which it has been called, or the time consumed while standing at the direction of ~the passenger. ~'No charge shall be made for t~me lost because of the inefficienc~ of the taxicab or its operator, or for time consumed by premature response to t!~e passenger's order. (b) Hourly and Flat Rate Taxicabs may accept employment whereby the fare is to be computed on an hourly rental basis or upon a flat rate of one dollar and forty cents ($1.40) for any ride within the city. A charge of $0.25 may be made for each additional passenger. Five cents ($0.05) may be added to the flat rate of one dollar and f~rty cents for any ride within the City, for each five cent ($.05) increase in the cost of gaaoline for taxicabs, above forty cenus ($.40) per gallon.
