ORDINANCE NO. 14-77 BY: <br /> <br />Messrs. McBride, Salmon, Usher, <br />Brockman, Chinnock, Magnotto <br /> <br /> AN EMERGENCY ORDINANCE to amend Sections 301.04, 301.11, 301.27,313.02, <br />331.38, 335.07, 337.16, 339.01, 339.03, 351.25, 381.09 and 381.16 of the Traffic <br />Code - Part Three of the Codified Ordinances of the City of Lakewood, Ohio and to <br />supplement the same by the enactment of a new Paragraph (e) to Section 351.23 of <br />said Traffic Code. <br /> <br /> WHEREAS, the present Traffic Code of the Codified Ordinances of the City <br />of Lakewood was enacted so that the same was in compliance with the applicable <br />corresponding provisions of the Statutes of the State of Ohio, and <br /> <br /> WHEREAS, subsequent to the enactment of the Traffic code of the Codified <br />Ordinances of the City of Lakewood, Ohio the State Legislature has made certain <br />revisions and additions to the various Statutes of the State goVerning traffic, and <br /> <br /> WHEREAS, this Council deems it to be in the best interest of all of the <br />citizens of the City of Lakewood to revise the City's Traffic Code to bring its <br />provisions in compliance with current State Law as the same has been amended since <br />the enactment of the present Traffic Code, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare and for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 301.04 of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood now reading as follows: <br /> <br /> 301.04 BICYCLE. <br /> "Bicycle" means every device propelled by human power, upon which any person <br />may ride having either two tandem wheels or one wheel in the front and two wheels in <br />thc rear, any of wtfich is more than fourteen inches in diameter; and includes any such <br />device, fitted with a helper motor rated less than one br,qkc horsepower transmitted by <br />friction and not by gear or chain, which produces o~dy ordinary pedaling speeds up to <br />a maximum of twenty miles per hour. That Section 301.11 of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood now reading as follows: <br /> <br /> 301.11 EMERGENCY VEHICLE. <br /> "Emergency vehicle" means vehicles of salvage corporations organized under Ohio <br />R.C. 1709.01 to 1709.07, emergency vehicles of municipal or county departments or <br />public utility corporations when identified as such as required by law, the Ohio Director <br />of Highway Safety or local authorities, and motor vehicles when commandeered by a <br />police officer.
