ORDINANCE NO. 14-77 BY: Messrs. McBride, Salmon, Usher, Brockman, Chinnock, Magnotto AN EMERGENCY ORDINANCE to amend Sections 301.04, 301.11, 301.27,313.02, 331.38, 335.07, 337.16, 339.01, 339.03, 351.25, 381.09 and 381.16 of the Traffic Code - Part Three of the Codified Ordinances of the City of Lakewood, Ohio and to supplement the same by the enactment of a new Paragraph (e) to Section 351.23 of said Traffic Code. WHEREAS, the present Traffic Code of the Codified Ordinances of the City of Lakewood was enacted so that the same was in compliance with the applicable corresponding provisions of the Statutes of the State of Ohio, and WHEREAS, subsequent to the enactment of the Traffic code of the Codified Ordinances of the City of Lakewood, Ohio the State Legislature has made certain revisions and additions to the various Statutes of the State goVerning traffic, and WHEREAS, this Council deems it to be in the best interest of all of the citizens of the City of Lakewood to revise the City's Traffic Code to bring its provisions in compliance with current State Law as the same has been amended since the enactment of the present Traffic Code, and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 301.04 of the Traffic Code of the Codified Ordinances of the City of Lakewood now reading as follows: 301.04 BICYCLE. "Bicycle" means every device propelled by human power, upon which any person may ride having either two tandem wheels or one wheel in the front and two wheels in thc rear, any of wtfich is more than fourteen inches in diameter; and includes any such device, fitted with a helper motor rated less than one br,qkc horsepower transmitted by friction and not by gear or chain, which produces o~dy ordinary pedaling speeds up to a maximum of twenty miles per hour. "Emergency vehicle" means vehicles of salvage corporations organized under Ohio R.C. 1709.01 to 1709.07, emergency vehicles of municipal or county departments or public utility corporations when identified as such as required by law, the Ohio Director of Highway Safety or local authorities, and motor vehicles when commandeered by a police officer.
