id) No disclOsure of information pursuant to subsection ia) or (b) hereof shall give <br />~ise to any liability or recrimination for a breach of privilege or confidence. <br /> <br /> (e) Whoever violates this section is guilty of,failure to report a crime. Violation <br />of subsection ia) hereof is a misdemeanor of the fourth degree. Violation of subsection (b) <br />hereof is a misdemeanor of the second degree. <br />(ORC 29,21.22)' <br /> <br />shall be and the same is hereby amend~d'.to' read as follows: <br /> <br /> 525.05 FAII,IUIE Ti) REP()IITA CRIME OR KNOWLEI)GE ()F DEAT[t. <br /> ia) No person, knowing that a felony has been or is being committed, shall knowingly <br />fall co report such information to law enforcement authorities. <br /> <br /> (b) No physician, limited practitioner, nurse or person g'iving aid to a sick or injured <br />person, shall negligently fail to report to law enforcement authorities any gunshot or stab <br />wound treated or observed by him, or any serious physical harm to persons which l~e knows <br />or has reasonable cause to believe resulted from an offense of violence, or any second or <br />third degree burn which was inflicted by an explosion or other Incendiary device, or any <br />burn which shows evidence of havhag been inflicted ha a violent, malicious or crlminal"~ <br />manner. <br /> <br /> (c) No person ;vho discovers the body or acquires the first knowledge of the' death of <br />any person shall fail to report such death immediately to m~y physician known by such per- <br />son to be treating the deceased for a condition from which death at such time would not be <br />unexpected, or to a law enforcement officer, a~nbulance service, emergency squad or the <br />County Coroner in the county in which the body is discovered, death is believed to have <br />occurred or knowledgelconcerning it is obtained. <br /> <br /> id) No person shall fail to provide upon request of the person to whom he has ~tiade a <br />report require[l by subsection (c) hereof, or to any law enforcement officer who has reason- <br />able cause to assert the authority to investigate the circumstmaccs surrounding such death, <br />any facts within his knowledge that may have a bearing on the investigation of such death~ <br /> <br /> (e) Subsection ia) or (d) hereof does not require disclosure of information, when any of <br />the following applies:' <br /> (1) The inforrpation is privileged by reason of the relationship between attorney <br /> and client, doctor and patient, licensed psychologist or licensed school <br /> psychologist and client, priest and penitent, or husband and wife. <br /> <br /> (2)~ Tho in.format]on would tend to incrimlnat(~ a member of the actor's immediate <br /> family. <br /> <br />,(3) I)isclosurt? of thc informalfion would amount to revealing a news source <br /> privileged under t)hio l{.C. 2739.0,t or 273.q. 12. i <br />(,i) I)isclosUre of tho information wotdd amount to disclosure by an ordained <br /> clergyman of an organized religious body of confidential communication <br /> made to him in ids capacity as such by a person seeking his aid or counsel. <br />(5) Disclosure would amount to revealing information acquired by the actor in <br /> the course of his duties in connection with a bona fide program of treatment <br /> or services for drug dependent persons or [mrsons in danger of drug depen- <br /> dence, which program is maintained or conducted by a hospital, clinic, <br /> person, agency or organization registered pursuant to Otfio R.C. 5122.51. <br /> <br /> (t) No disclosure of information pursuant to this section gives rise to any liability or <br />recrimination for a breach of privilege or confidence. <br /> <br /> (g) Whoever violates subsection ia) or (i.~) hereof is [,milty of failure to report a crime. <br />Violation of subsection ia) hereof is a misdemeanor of the fourth degree.
