ORDINANCE NO.: 63-77 <br /> <br />BY: Messrs. Sinagra, Usher, Brockman, <br /> Chinnock, Magnotto, McBride, Salmon <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of <br />Public Works to employ by contract the Suburban Power Piping Corporation, <br />3800 Brookside Park Boulevard, Cleveland, Ohio, 44109 for the purpose of <br />repairing a 12-inch watermain in the Riverside Drive bridge structure over <br />Interstate 90. <br /> <br /> WHEREAS, on or about September 29, 1977, the City issued a purchase <br />order to the Suburban Power Piping Corp. in an anticipated amount not to exceed <br />$2,950.00 for the repair of ruptured joints and the replacement of insulation <br />on a 12-inch watermain in the Riverside Drive bridge structure over Interstate <br />90, and, <br /> <br /> WHEREAS, the purchase order was issued based on what was believed <br />to be the scope of work required to restore this 12-inch watermain to service, <br />and, <br /> <br /> WHEREAS, on or about October 5, 1977 during the repair of ruptured <br />pipe joints on the 12-inch watermain, it was discovered that more pipe joints <br />than that which had been originally anticipated required repair prior to re- <br />storing this main to service, and, <br /> <br /> WHEREAS, the Suburban Power Piping Corp. has completed 45% of the <br />necessary repairs and proposes to complete repairs to restore this 12-inch <br />watermain to service based on their originally quoted unit prices, and, <br /> <br /> WHEREAS, it is now accurately estimated that the total cost of work <br />to restore this 12-inch watermain to service shall not exceed $9,000.00, and, <br /> <br /> WHEREAS, the City does not have the necessary equipment and manpower <br />to complete the repairs to the 12-inch watermain, and, <br /> <br /> WHEREAS, a real and present emergency exists in that it is necessary <br />that repairs be made to the 12-inch watermain without further delay, and it is <br />necessary to enter into a contract immediately in order to insure that such <br />repairs be made prior to the winter months, and for the reason that further <br />delay would be dangerous to the health, safety and welfare of the citizens of <br />Lakewood, and, <br /> <br /> WHEREAS, a delay, in order to comply with the competitive bidding <br />requirements of the Charter of the City of Lakewood, will be dangerous to the <br />health, safety and ~elfare of the citizens of Lakewood, and, <br /> <br /> WHEREAS, pursuant to the Ohio Revised Code 735.051, the legislative <br />authority of a municipal corporation may, by a two-thirds vote, contract for <br />the purchase of construction work without formal bidding and advertising in <br />the case of a real emergency arising in connection with the operation and <br />maintenance of the Department of Public Works, and, <br /> <br /> WHEREAS, this Ordinance constitutes an emergency in that it provides <br />for the immediate preservation of the public health, safety, welfare and pro- <br />perty and provides for the usual daily operation of a municipal department, <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized to employ by contract the Suburban Power Piping Corp. for the <br />purpose of completing repairs on a 12-inch watermain in the Riverside Drive <br />bridge structure over Interstate 90 for a total sum not to exceed $9,000.00 <br /> <br /> <br />
