ORDINANCE NO. 3-78 BY: Messrs. Brockman, Brown, Chinnock, Magnotto, Salmon, Usher AN EMERGENCY ORDINANCE authorizing and directing the Mayor, for., and on behalf of the City of Lakewood to execute a Grant of Easement granting an easement to Lakewood Medical. Associates over and upon the overhead walkway from the Lakewood Professional Building to the municipal parking garage and upon part of the driveway between the two buildings. ~tEREAS, this Council Js of the opinion that an easement ought to be granted to Lakewood Medical Associates over and upon the enclosed . overhead walkway from the Lakewood Professional Building to the municipal parking garage and upon part of the driveway between the two buildings, and W~EREAS, this Council is of the oPinion that the granting of such easement is in the best interests of the City of Lakewood and will further the interests of the City and its residents, and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate, preserw~tion of the public health and safety and for the further reason that such easement ought to be granted without further delay to remove a cloud upon the title to said property; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Council of the C~ty of Lakewood does hereby determine that an easement ought to be granted to Lakewood Medical Associates, and Ohio General Partnership over and upon certain property of the City of Lakewood for the length and width of the enclpsed overhead walkway presently in existence extending from the third floor of the Lakewood Professional. Building to the third level of the municipal, parking garage, and also upon that part of the driveway owned by the City of Lakewood located between the two buildings. Section 2. That the Council of the City of Lakewood does hereby determine that the granting of such easement is Jn the best interests of the City of Lakewood and will further the interests of the City and its residents. Section 3. That the blayor be and he is hereby authorized and directed to enter into a Grant of Easement which is in substantially the form attached hereto and marked "Exhibit A." Section 4. That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble he'~,eof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force from and after the earliest period allowed by law. .~ Adopted :~~4.~ rover _~., /'~ ~ .
