<br /> AN EI~GENCY ORDINANCE to amend and suppl~nent Chapter 143 of the
<br />Administrative Code of the Codified Ordinances of the City of Lakewood~
<br />entitled "City Records Commission" and to repeal all ordinances in conflict
<br />therewith..

<br /> WHEREAS, since the date of the enactment of Chapter 143 Of the
<br />Administrative Code of the Codified Ordinances of the City of Lakewood there
<br />have been certain amendments and additions to the Ohio ReVised Code pertaining
<br />to the disposal of records, and
<br />
<br /> WHEREAS, this Council deems it to be in the best interests of the
<br />City to amend and supplement Chapter 143 of the Administrative Code to bring
<br />its provisions into conformity with current statutes, and
<br />
<br /> WHftLEAS, this ordinance constitutes an emergency measure providing
<br />for the usual daily operation of a municipal department; now, therefore,
<br />

<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEW0OD, STATE OF
<br />
<br /> Section 1. That Chapter 143 of the Administrative Code of the
<br />Codified Ordinances of the City of Lakewood now reading as follows:
<br />
<br /> CHAPTER 143
<br />City Records Con~ission
<br />
<br />143.01 ESTABLISHMENT AND MEMBERSHIP
<br />
<br /> There is hereby established a City Records Con~ssion to be
<br />composed of the Mayor, one member of Council appointed by the President,
<br />the senior Judge of the Municipal Court, the Director of Law and the
<br />Finance Director.

<br />143.02 DESTRUCTION 'OF RECORDS REQUIRED RI) BE RECORDED; PBOCED~
<br />
<br /> The City Records Con~nission may order the destruction or other
<br />disposition of any City record, document, plat, court file, paper or
<br />instrument in wr±ting, required to be recorded by law, provided that
<br />such City record, document, plat, court file, paper or instrument in
<br />writing is first copied or reproduced in the manner and according to
<br />the procedure prescribed in Ohio R.C. 9.01. Before such order may be
<br />given'by the Con~ission, the officer or person in charge, or the
<br />majority where there are more than one, of any office, court, con~nission,
<br />board, institution, department or agency of the City, shall request
<br />in writing that such p~rmission be granted. When such application is
<br />made by a member of the Comnission, that member shall not serve in the
<br />consideration of that application.
<br /> No order of the Con~nission to.destroy or otherwise dispose of any
<br />records is valid unless it is agreed to by each such member of' the
<br />ComnissiOn eligible to act under this section, reduced to written form
<br />and signed by each member.

<br /> PROCEDIY~
<br />
<br /> Any officer or person in charge,' or the majority where there are
<br />more than one, of any office, court, con~nission, board, institution,
<br />department or agency of the City, may request in writing that
<br />permissio~ be granted to destroy or otherwise dispose of records,
<br />papers or instruments that are not specifically required .by law to be
<br />kept, without being copied or reproduced as prescribed in Ohio R.C.
<br />9.01, and which do not involve any title to or right in property or
<br />constitute a regular record of any co~u't, if such records, papers or
<br />
