-2- <br /> <br />instruments are more than ten years old and do not pertain to any <br />pending case, claim or action and no longer have any value, historical <br />or otherwise. When any such application is made by a member of the <br />City Records Conraission, that member shall not serve in the <br />consideration of that application. <br /> No order of the ~ssion to destroy or otherwise dispose of <br />any records mentioned in this section shall be valid unless it is <br />agreed to by each such member of the Con;nission eligible to act <br />under this section, reduced to written form and signed by each <br />member. <br /> <br />143.04 RESO~ION TO DESTROY RECORDS <br /> <br /> If the City RecOrds Conanission derans it advisable to destroy <br />or dispose of the records mentioned in this chapter, it shall adopt <br />a resolution setting forth what records are to be destroyed or <br />disposed of. <br /> <br />143.05 COMPLINE REQUIRED <br /> <br /> No person having the custody of any records shall destroy or <br />dispose of'them, or procure or permit the destruction or other <br />disposition of them, without complying with this chapter. <br /> <br />143.99 PENALTY <br /> <br /> Whoever violates Section 143.05 shall be fined not.less 'than <br />fifty dollars ($50.00) nor more than three hundred dollars ($300.00). <br /> <br />shall be and the same is hereby amended and supplemented to read as follows: <br /> <br />143.01 ESTABLISHMENT AND MEMBERSHIP <br /> <br /> There is hereby established a City Records Con~nission to be <br />composed of the Mayor, one member of Council appointed by the President, <br />the senior Judge of the Municipal Court, the Director of Law and the <br />Director of Finance. <br /> <br />143.02 FUNCTIONS OF ODMMISSION <br /> <br /> The functions of said Con~nission shall be to review all applications <br />for records disposal or transfer and all schedules of record retention <br />and destruction and all records disposal lists submitted by any office, <br />court, conrnission, board, department or agency of the City. Such <br />records may be disposed of by order of the COna~ission pursuant to <br />the procedure hereinafter outlined. <br /> <br />143.03 DESTRUCTION OF RECORDS RI~UI~ TO BE RECOF~ED. <br /> <br /> The City Records Comnission may order the destruction or other <br />disposition of any City record, document, plat, court file, paper or <br />instrument in writing, specifically required by law to be kept or <br />recorded, provided that such City record, document, plat, court file, <br />paper or instrument in writing, is first copied or reproduced in the <br />manner and according to the procedure prescribed in Section 9.01 of the <br />Ohio Revised Code. <br /> <br />143.04 DESTRUCTION OF RECORDS NOT Rt~uIRED TO BE RFL~RDED. <br /> <br /> The City Records Con~nission may order the destr&ction or other <br />disposition of any City record, document, plaT, court file, paper or <br />instrument in writing not specifically required by law to be kept without <br />being copied or reproduced as prescribed., in Section'9.01 of the Ohio <br />Revised Code, and which does not involve any. title to or right in <br /> <br /> <br />
