<br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to
<br />except a certain easement from the Clifton Park Trustees for the construction
<br />of a water main and the necessary appurtenances thereto.
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure in that
<br />this Council deems it necessary to proceed as quickly as possible with the
<br />construction of the proposed water main and that it provides for the immediate
<br />preservation of the public health, safety and welfare and for the usual daily
<br />operation of a municipal department; now, therefore
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That for and in consideration of the sume of one dollar
<br />($1.00) paid by the City of Lakewood, Ohio, the Director of Public Works be
<br />and he is hereby authorized and directed to except an easement from the
<br />Clifton Park Trustees in substantially the following form:
<br />
<br />Parcel No. 1
<br />
<br />Situated in the City of Lakewood, County of Cuyahoga, State of
<br />Ohio and being part of the Clifton Park Land and Improvement
<br />Company's Allotment No. 2 as shown by the recorded plat in
<br />Volume 48 of Maps, Page 3, and known as being part of Original
<br />Rockport Township Section No. 23 and further described as part
<br />of Permanent Parcel No. 311-2-1 of the tax records of the County
<br />of Cuyahoga, bounded and described as follows:
<br />
<br />Beginning at a stone monument at the Southwesterly corner of
<br />Beach Road (private) and Lake Road, 50 feet wide; thence
<br />S 21° - 47' - 30" E, a distance of 53.10 feet, more or less,
<br />to a point located approximately 14 feet west of the westerly
<br />right of way line of Lake Road; thence S 78° - 12' - 30" W,
<br />a distance of 100.00 feet, more or less, to a point; thence
<br />S 86° - 42' - 30" W, a distance of 97.50 ~eet, more or less,
<br />to a point; thence N 79° - 47' - 30" W, a distance of 60.00
<br />feet, more or less, to a point; thence N 666 - 47' . 30" W,
<br />a distance of 39.00 feet, more or l~ss, to a point in the
<br />sontherly ]i,e of Permanent Tax Parcel No. 311-2-1, said point
<br />being the principal place of beginning of the centerline of the
<br />easement.

<br /> The easement shall extend seven and one-half (7.5) feet on either
<br /> side of a line beginning at said principle place of beginning and
<br /> continuing N 66° - 47' - 30" W, a d~stance° of 31.00 feet, more or
<br /> less, to a point; thence N 50° - 17' - 30" W, a distance of 59.00
<br /> feet, more or less, to a point;' thence N 43° - 47' - 30" W, a
<br /> distance of 41.00 feet, more or less, to a point; thence N 32° -
<br /> 17' - 30"W, a distance of 89.00 feet, more or less, to a point; thence
<br /> N 11° - 17' - 30"W, a distance of 123.00 feet, more or less, to a point;
<br /> thence N 68° - 47' - 30"W, a distance of 192.00 feet, more or less, to
<br /> a point which terminates the easement of Parcel No. 1.

<br />Company's Allotment as shown by the recorded plat in Volume 29
<br />of Maps, Page 11, of Cuyahoga Co,nty Records and known as being
<br />part of Original Rockport Township Section No. 23 and further
<br />described as part of Permanent Parcel No. 311-3-3 of the tax
<br />records of the County of Cuyahoga, bounded and described as
<br />follows:
