ORDINANCE NO. 30-78 <br /> <br />BY: Messrs. McBride, Salmon, Usher, <br /> Brockman, Brown, Chinnock, Magnotto <br /> <br />AN EMERGENCY ORDINANCE to amend Section 137.11 of the Administrative Code <br />of the Codified Ordinances of the City of Lakewood providing for payment <br />of overtime services for members of the Division of Fire, other than the <br />Chief of the Division of Fire, effective February 1, 1978. <br /> <br />WHEREAS,'this Council recognizes that inherent in the duties of fire fighting, <br />emergency situations may exist whereby members of the Division of Fire may be <br />called back to duty while off duty or required to remain on duty beyond their <br />regular scheduled working hours, and <br /> <br />WHEREAS, this Council determines it to be appropriate that members of the <br />Division of Fire, other than the Chief of the Division of Fire, should receive <br />extra compensation for such required additional duty, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 137.11 of the Administrative Code of the Codified <br />Ordinances of the City of Lakewood now reading as follows: <br /> <br />137.11 OVERTIME COMPENSATION <br /> <br />(a) <br /> <br />In the event it is necessary to call back to duty a member of the <br />Division of Fire while he is off duty or it is necessary for a <br />member of the Division of Fire to remain on duty beyond hi.s regular <br />working hours, or a member of the Division of Fire devotes off duty <br />time attending school or Fire Training Courses at the City's <br />request or direction, such member of the Division of Fire, other than <br />the Chief of the Division of Fire, shall for each instance of such <br />overtime service of one (1) hour or more, based upon a fifty-six <br />(56) hour work week, be entitled to compensation for such overtime <br />service in the form of compensatory time off computed at one and one- <br />half times the overtime actually incurred. <br /> <br />(b) All compensation in the form of compensatory time off shall be subject <br /> to the approval of the Director of Public Safety. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />137.11 OVERTIME COMPENSATION <br /> <br />(a) <br /> <br />All employees retained on duty or called back to duty, for whatever <br />reason, shall be paid in accordance with the overtime formula <br />provided herein. Any employee called back to duty for any reason <br />shall receive credit for a minimum of three (3) hours worked, or <br />actual time worked, whichever is greater. <br /> <br />(b) <br /> <br />Compensation owed for all overtime work shall be accrued in an <br />overtime account of each employee at the rate of one and one-half <br />(I-1/2) times the actual time worked, subject to the minimum <br />credit for call back referred to above. Accrued time in the <br />overtime account of each employee, not taken by him in the form <br />of compensatory time, shall be paid him at his current hourly <br />earning rate at the time of 'the employee's retirement, termination <br />or resignation, or to his estate in cash of the employee's death. <br /> <br />(c) All compensation in the form of compensatory time off shall be <br /> subject to the approval of the Director of Public Safety. <br /> <br /> <br />
