ORDINANCE NO. 63-78 <br /> <br />BY: Messrs. Broc~man, Brown, Chinnock, <br /> Magnotto, McBride, Salmon <br /> <br />AN EMERGENCY ORDINANCE to amend Section 725.O1 of the Business Regulation <br />Code of the Codified Ordinances of the City of Lakewood relating to the <br />definition of public exhibitions. <br /> <br />WHEREAS, this ordinance const'itutes an emergency measure providing for <br />the immediate preservation of the public safety and general welfare and <br />for the usual daily operation of municipal departments; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 725.O1 of the Business Regulation Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />725.O1 PUBLIC EXHIBITIONS; PERMIT REQUIRED; SAFETY MEASURES <br /> <br />No person shall arrange for, promote or give any public <br />exhibition of performance called or known as a stunt, such <br />as climbing the front of a building or sitting on top of <br />a flag pole or similar performance,.without first obtaining <br />a permit therefor from the Director of Public Safety, who <br />may grant such permit upon the payment of ten dollars <br />($]o.oo). <br /> <br />Any person giving or arranging for such performance, if a <br />permit is granted therefor, shall provide and use in every <br />case of such performance, and keep properly stretched in <br />place, suitable netting or other like adequate protection <br />under the performer. Such protection shall secure the <br />performer and any person in the public highways, or on <br />private property from injury in case of accidental fall. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />725.01 PUBLIC EXHIBITIONS; PERMIT REQUIRED; SAFETY MEASURES <br /> <br />(a) <br /> <br />No person shall arrange for, promote or give any <br />arts and crafts exhibition on public property which shall <br />include all sales, services and performances incidental <br />thereto without first obtaining a permit therefor from <br />the Director of Public Safety who may grant such permit <br />upon payment of fifty dollars ($50.00). <br /> <br />(b) <br /> <br />No person sha.]l~arrange for, promote or give any per- <br />formance called or known as a stunt, such as cli~bin9 <br />the front of a building or sittin9 on top of a fla9 <br />pole or similar performance, without first obtainin9 <br />a permit therefor from the Directon' of Public Safety <br />who may grant such permit upon the payment of ten <br />dollars ($10.OO). <br /> <br />Any person giving or arranging for such performance, <br />if a permit is granted therefor, shall provide and <br />use in every case of such performance, and keep <br />properly stretched in place, suitable netting or other <br />like adequate protection under the performer. Such <br />protection shall secure the performer and any person <br />in public highways or on private property from injury <br />in case of accidental fall. <br /> <br /> <br />
